MIAMI— Already perceived as a sleazy porn company, Reality Kings has a real public relations problem. Embroiled in a public sex scandal just earlier this year, the company is now arguing that a 15 year-old girl used a fraudulently obtained Nevada learner’s permit and government-issued Social Security card to dupe them into shooting her.

Reality Kings evidently forget the history of both Traci Lords and Alexandra Quinn both of whom did exactly the same thing, thus prompting recalls of their product and sending at least one person, Ruby Gottesman, to jail for distributing Lord’s movies.

In this latest case, a performer claiming to be Tyler Chanel Evans and using the stage name Bieyanka Moore worked for Reality Kings, and, as a result, Moore’s mother Sherrita Smalley filed a multi-count lawsuit against the Miami-based company in late December for allegedly knowingly using her daughter in a porn movie. Reality Kings filed a Motion to Dismiss in March.

Smalley, on behalf of her and her daughter [referred to as plaintiff C.S. for her real name Charrida Smalley], alleged that RK Netmedia, Reality Kings and C2 Hostings violated several state statutes when they hired her daughter to perform in a video titled Cum Fiesta that was first distributed over the internet in September 2010.

Smalley’s complaint cites Florida statute §847.012, which in part prohibits a person from knowingly using a minor in the production of a porn video. The complaint states that the defendants “knowingly used the minor Plaintiff, C.S., in the production of video media as prohibited by” the statute. Smalley’s lawsuit seeks compensatory and punitive damages under other Florida statutes, as well, including ones for statutory rape and negligence.

The complaint alleges a conspiracy by the defendants to “produce, promote, disseminate and profit” from the sexual exploitation of a minor, and also claims that the defendants “conspired to cause the minor Plaintiff to travel from Nevada, where she was living after running away from home, to Florida for the specific purpose of photographing and videotaping the minor Plaintiff nude and engaging is sexual activities…”

Evidence submitted to the court by the plaintiffs’ lawyer consisted of the girl’s birth certificate and a copy of the adult movie she allegedly performed in under the stage name Bieyanka Moore.

Miami New Times first broke the story, Monday: “In January 2010, a 15-year-old girl from Palm Beach Shores — though her name has already been broadcasted on the internet, we’ll call her C.S. — ran away from home.

“Eight months later, porn site Reality Kings, owned by Brickell-based smut giant RK Netmedia, uploaded a new film. It was called Cum Fiesta and featured a new porn starlet going by the name Bieyanka Moore.

“Now C.S.’s mother, Sherrita Smalley, has filed suit against RK, claiming that her underage daughter and Bieyanka Moore are one and the same — constituting “sexual battery, statutory rape, [and] child pornography.”

“Pictures from Bieyanka Moore’s purported MySpace and Twitter pages look strikingly similar to the photo of C.S. given to Nevada Child Seekers by her grandmother. And Moore has a tattoo — four stars on the right side of her neck — matching C.S.’s description. The runaway is in police custody in Nevada, says Smalley’s Miami-based attorney, Mark A. Glassman, and her case is being investigated by the FBI. “This is a lot more complex than she showed up and got in a movie,” he says. “A 15-year-old did not orchestrate this alone.”

“RK claims the actress known as Bieyanka Moore provided producers with a valid Nevada learner’s permit, purporting her to be 19-year-old Tyler Chanel Evans, and a corresponding social security printout. If those documents were bogus — as RK appears to concede in some filings — it’s the minor’s fault: “But for this criminal activity by C.S., she never would have been able to mislead [RK],” the company claimed in court.

“A few hours after uploading Moore’s film debut, says RK attorney Stuart I. Grossman, the porn company received an anonymous tip claiming she was underage. “They took down the video immediately and called the FBI,” Grossman says. “The bottom line is RK did everything it could to verify the actress’s age.”

“As the case unfolds, there is one person who should be worried: the as-yet-unidentified male porn star who had on-camera sex with Bieyanka Moore. Florida criminal law decrees that “a minor’s misrepresentation of his or her age… may not be raised as a defense” in statutory rape prosecution.”

According to an www.avn.com story, RK’s Attorney Grossman is arguing:
“[The] Plaintiffs allegations attempt to paint a picture that Defendants somehow took advantage of or conspired to take advantage of C.S. Nothing could be farther from the truth.”

“Defendant has been dragged into this lawsuit because of the misrepresentations C.S. made regarding her age to various state and federal agencies and Defendant. Specifically, C.S. procured a valid Nevada driver’s permit with her picture on it which said she was nineteen and identified her as Tyler Chanel Evans.” She also fraudulently procured a social security card in the same name, the motion contends, and has since been arrested in Nevada for, among other things, possession of a false license.

But for this criminal activity by C.S.,” the motion states, “she would never have been able to mislead defendant.” The motion then outlines a litany of problems with the plaintiff’s use of Florida statutes that fatally undermine the complaint, and asks the court to dismiss the complaint with prejudice.

Update: From www.nowrepublic.com – Bieyanka Moore tweeted last year that she was not a 15-year-old runaway, despite looking a lot like her, but now the runaway’s mother in Palm Beach Shores, Sherrita Smalley, has filed a suit against porn site Reality Kings.

Reality Kings is owned by RK Netmedia, and they uploaded a film last year called Cum Fiesta, featuring Bieyanka Moore.

Smalley has filed a suit, saying Moore and her daughter are in fact the same person, and the suit claims ‘sexual battery, statutory rape, and child pornography.’

Cum Fiesta had only been online for a few hours when RK received a tip that Bieyanka Moore was underage. They took down the video immediately and then called the FBI.

The man who had sex on camera with Moore has not been identified at this time, but he may be in trouble if she is found to have been 15-years-old at the time.
