LOS ANGELES – The video of Colin Farrell’s steamy sex romp with a Playboy playmate can’t be sold or posted on the Internet anytime soon, a judge ruled yesterday.
Judge David Yaffe granted a preliminary injunction making it unlawful to show, market or distribute the 15-minute tape of the “Alexander” star’s tryst with Nicole Narain until the lawsuit is resolved.
“We’re pleased with the result. My client’s privacy rights should be preserved,” said Farrell’s lawyer Martin Singer.
Singer says he hopes Yaffe will issue a final judgment permanently barring display and distribution of the tape without Farrell’s consent, but if not, “We’ll go to trial.”
Last month, Farrell sued Narain for breach of oral contract and invasion of privacy after he found out she was allegedly involved in a marketing deal with two porn brokers.
Narain’s lawyer Leotis Matthews yesterday denied she had any “agreement” with the two brokers, David Schmidt and Paul Nash.
The former Miss January is opposed to release of the tape by any third party “at this time,” Matthews said, but “at some date in the future that may change.”
The judge wasn’t buying Matthews’ position.
“Are you saying, ‘Not today … but we might change our mind tomorrow?'” the judge asked. “We have to determine who has the rights to this tape and not let your client exploit it without Mr. Farrell’s consent.”
Narain, who dated Farrell 21/2 years ago, believes “she has the right to decide” what happens to the tape, but Farrell’s view “is that he totally controls ownership,” Matthews said.
The tape reportedly features “various acts of copulation.”
Singer said Farrell does not even have a copy of the tape, but Schmidt “represented that they have one.”
Singer said he offered to drop the suit against Narain if she would join Farrell in his suit to block distribution of the tape, but she refused.
“We offered to drop the case and not seek one penny of damages against her if she would join with us in our action. … As of today, she has refused.”
