California- Breasts Not Bombs has, or have, sued California Highway Patrol Commissioner Mike Brown in Federal Court, claiming they have a valid permit to stage a topless protest against the Iraq war and Gov. Arnold Schwarzenegger’s political reform initiatives at the State Capitol on Monday, Nov. 7, but Brown has threatened to arrest them and force them to register as sex offenders if they take it off in public.

Plaintiff says defendant CHP Officer Troy, who issued the permit, threatened to arrest only female members of Breasts Not Bombs, which would violate their rights under the First and 14th amendments. Represented by Matthew Kumin of San Francisco, they seek an emergency injunction.
