WWW- Despite Jennifer Aniston’s widely publicized lawsuit against a photographer and other “unnamed defendants,” some websites have posted the now infamous topless photos of the actress, taken while she was sunbathing at her Los Angeles home. Those websites apparently believe themselves free from legal liability, but they need to watch out, warns one industry expert.
“Everyone in this country has a right to privacy, and any judge is going to rule in Jennifer’s favor because of the way that the photographs were obtained,” says Kevin Blatt, a public relations specialist for the adult industry. Blatt has been involved in the release of sex tapes featuring celebrities including Paris Hilton, Cameron Diaz and Tom Sizemore. He is is currently writing a book on the subject.
“They’ll all be liable,” Blatt says, “especially when it’s Jay Lavely who’s [Aniston’s] attorney.” Lavely and his partner Martin Singer are top celebrity sex tape attorneys. “Lavely is ruthless; he’ll definitely get everyone,” says Blatt. “Ultimately, Lavely and Singer will have a field day with anyone who’s posted these photographs.” Lavely and Singer did not respond to a request for comment.
Some websites have superimposed black bars over Aniston’s nipples. But Blatt says this won’t help them avoid a lawsuit. They will, however, keep the websites from potential liability under what is commonly referred to as the federal government’s “2257 law,” which requires makers of pornographic material to provide documentation of the model’s age.
