FCC Chairman: Indecency Campaign Falls Short

LAS VEGAS — A $300 million educational campaign planned by TV broadcasters to ward off increased federal regulation of indecent program content doesn’t go far enough, Kevin Martin, chairman of the Federal Communications Commission, said Tuesday.

Martin, speaking before hundreds of TV and radio station executives at the annual National Association of Broadcasters show, said the educational campaign, announced Monday, was not a “complete answer” to the large number of complaints filed each year by parents about inappropriate language and sexual content in shows.

Broadcasters on Monday said they would step up efforts to educate parents about the V-chip, a ratings system, and other controls they have to regulate what their children see on TV. They said a voluntary program was better than increased federal scrutiny.

Martin said Tuesday that the FCC was generally supportive of such efforts “and thinks its a good thing for parents to understand how to have more control.”

But he said the program falls short in part because a significant number of TVs do not include the V-chip.

“Even those that do, some of the programs are still either unrated or live sports broadcasting like the Super Bowl that probably would not have been rated in a way that would make parents aware,” Martin said. “So I’m not sure that is the complete answer. I think there are other things that still need to be done.”

The FCC stepped up its regulation of TV shows after the 2004 Super Bowl during which Janet Jackson’s bared breast showed briefly during a dance routine. The FCC has proposed a $550,000 fine against CBS for Jackson’s “wardrobe malfunction.”

Martin said he would continue to push for additional steps, such as cable TV companies giving customers a choice of which channels to pay for rather than offering bundles of channels. Martin also said cable companies should offer a “family tier” of channels as well.

Martin also declined to give the group more specific guidelines on exactly what constitutes “indecency” under the law.

Broadcasters have complained that the federal rules are vague and enforcement is inconsistent, yet millions of dollars in fines have been levied based on the standards. Two weeks ago, four TV broadcast networks and their affiliates filed court challenges to an FCC ruling that found several programs “indecent” because of language.

Martin said he thought the FCC’s stance on the issue was clear.

“When the commission’s indecency rules were originally upheld by the Supreme Court, it was on a monologue by George Carlin entitled ‘The seven words you can’t say on TV and radio,'” Martin said. “Well, the commission’s findings recently did not extend beyond some of those same words that were found to be upheld by the Supreme Court.

“I’m not sure when people say they want additional guidance that it’s that different than it was back in 1978-79 as far as some of the words that are still on that list.”
