Phoenix- Legislation to require jail time for prostitution is on the verge of being approved.

The House on Tuesday approved a bill that would require 15 days in jail for a first offense, 30 days for a second offense, 60 days for a third and 180 days for any additional offenses. The bill (HB2307) now faces a vote in the Senate, where the jail mandate had been previously removed before being restored in the bill’s latest version.

Prostitution currently is a misdemeanor punishable by up to six months in jail and a fine of up to $2,500 plus surcharges, but the bill would make a fourth or subsequent offense a low-grade felony.

Phoenix allows convicted prostitutes to avoid jail time once by taking a “dignity diversion program.”
