Sex Businesses Violate New Ordinance

El Paso, Texas- Six adult businesses are accused of violating the city’s new regulations for strip clubs and X-rated shops after a sweep of those establishments on Tuesday by building inspectors and police.

Police spokesman Javier Sambrano said the inspection also produced the first arrest for violating the sexually oriented business ordinance, which went into effect at midnight Dec. 30

Richard Hamm, 40, manager of the Naked Harem, was arrested on a charge that the club at 6345 Alameda was operating after 2 a.m. The violation is a Class A misdemeanor punishable by up to one year in jail and a fine not to exceed $4,000.

Sixteen of the 19 adult businesses within the city were inspected this week, said Irma Medina, spokeswoman for the city of El Paso.

Three businesses were not inspected because they are under review for other legal matters.

The ordinance, adopted in September, requires each adult business to get a license from the city, to keep employee records available for review and to allow city authorities to inspect the businesses.

Medina said inspectors did not issue citations but instead will turn over findings to police, who will consider filing criminal charges with the district attorney’s office.

Medina said the adult businesses allegedly in violation of the ordinance are:

Prince Machiavelli, 533 Executive Center: not having its license posted, incomplete employee records.

Naked Harem: not having a license, not having employee records, operating after hours.

Cabaret Nude Club, 4834 Montana, and J.B.’s Lounge, 6742 Edgemere: incomplete employee records.

Nero’s, 10662 Vista Del Sol: not having a license.

Eva’s Bookstore: 1903 Texas, not having employee records.

Jesus Diaz, general manager of Eva’s Bookstore, said the businesses does have complete records but didn’t have them at the shop Tuesday. “I accept our mistake. We have the records here now,” Diaz said.

Here are some of the provisions included in the adult-business ordinance adopted earlier this year by the City Council:

Definition of a sexually oriented business: Adult arcade, adult bookstore or adult video store, adult cabaret, adult motion picture theater, nude model studio, or other commercial enterprise whose primary business is the offering of a service or the selling, renting or exhibiting of devices or any other items intended to provide sexual stimulation or sexual gratification to the patron.

Licenses: $550 for initial, $350 for annual renewal. Must include names of all applicants, expiration date, address of adult-oriented business and be posted in conspicuous place near entrance of business.

Inspections: For compliance, by the El Paso Police Department, City-County Health and Environmental District, El Paso Fire Department, the city’s Building Permits and Inspections.

Identification records: Full legal name, all aliases or stage names, date of birth, copy of employee’s driver’s license or government-issued identification card, color photograph with full face view.

Hours: Businesses must be closed between 2 and 6 a.m.

Violations: Class A misdemeanor punishable by up to one year in jail and a fine not to exceed $4,000
