Delaware and I spoke Wednesday morning after he was let out of jail. Delaware says, yes, he was arrested and held for $50,000. But that was the extent of it. Delaware swears he never laid a hand on Cruz and that he loved her. Delaware also confirms that Cruz is three weeks pregnant.

“I have to believe that she would get an abortion and Mike Sullivan is the reason why- I don’t know who told her to call you but I really would like to find out,” says Delaware.

According to Delaware, Sullivan is Cruz’s “personal advisor.”

“I’m very jealous of Mike Sullivan,” Delaware said. “She thinks very highly of Mike Sullivan. She talks about his cock as being the best cock in the world. And she’ll be, like, Mike Sullivan this. I think that’s who she really wants to be with. I’m very envious of him because of that. I don’t have any bad intentions for Mike Sullivan. I don’t feel like I want to have any anger with him. I heard he bought a shotgun to protect himself from me which is total bullshit. There’s no need for that. No one’s in any danger from me. There’s no need for that and he’s not worth that.”

Before he said anything else, the one thing that Delaware wanted to make clear is that he thought the world of Cruz.

“The girl is a great example to me,” he said. “I met her- I fell for her really fast. She’s beautiful. She’s the best I’ve ever had in sex- I’ll be straight up with you. I’m not going to bad mouth her. She made me fall for her.

“But she did me wrong yesterday,” Delaware went on to say. “She got mad at me.” Delaware’s version of the Internet cafe incident is much different than the one that Cruz presents.

According to Delaware, he had some MySpace messages he wanted to take a look at including one from Layla Starr about attending a party.

“She [Cruz] freaked out about that,” said Delaware. “And she left me there. If I was looking at her MySpace and I was mad, why would I be the saying she left me there? And she left me walk from Topanga Canyon and Sherman Way in blazing heat all the way home to Woodlake and Burbank. That’s about three miles. And I was very upset with her.”

Delaware said he was mad to the point he was telling Cruz he was going to have her evicted.

“Basically I was talking shit to her- I was bluffing her,” says Delaware. “I had no reason to go off on her but I was so mad from walking in the heat.” But Delaware says that isn’t the first time it happened. The day before she made him walk from Topanga Canyon and Nordhoff back home.

By the time Delaware got home Tuesday, however, Cruz wasn’t there.

“But I had to go to this casting call and I knew she was going there,” he says. “We were arguing about it already. And so I text messaged her, where are you at? Then Harry Weiss [who is also Delaware’s agent] came to pick me up to take me to the casting call in West Hollywood which was supposed to be at 2 o’clock.”

According to Delaware, Weiss needed some gas and pulled into a station.

“And who do I see right there- she’s pacing back and forth, she’s on her cellphone,” said Delaware. “Her car was there but she looked like she was going to get into someone else’s car.”

Delaware got out of Weiss’ car, and Cruz’s car was running with the air conditioning going.

“I got in the car and I was going to shut the car off,” Delaware continues. “She comes up to me and tries to stop me from getting the keys to the car. Then she runs around the passenger’s side, jumps in the car with me. I get the key out of the ignition and start walking towards Harry. She starts running after me and grabbing a hold of me, tries to grab the key out of my hand. I close my hand. I didn’t release it. I got into the car with Harry. She reached into the car, grabbing into the car. Harry Weiss witnessed every bit of this. He watched the whole thing. Then she finally turned away from me and flagged a police car down that was across the street. That’s when I threw the key down to the ground. I motioned to her there’s your stupid key. Then she still kept motioning for the police. I was what the fuck is she doing, I didn’t understand what she was trying to do at this point. She was absolutely livid.”

According to Delaware with Weiss driving, they got pulled over by the police.

“The police were, like, okay there’s a witness who saw the whole thing. He’s like, yeah, I saw this girl waving so I stopped. I didn’t see him touch her. Harry saw the whole thing. I did not touch her; I did not grab her. I did not put one finger on her. The police asked her to stay to take pictures of her wound which she claimed was from me grabbing her. When they looked at it closely, they realized it was an abrasion and probably did it while she was reaching in through the car at me. That’s what they were doing -they were talking about it. I was, that’s exactly what she did. She was trying to grab the key out of my hand. The next thing you know she bails when the CSI officer shows up. I don’t know whether she was trying to help me or just going off to the casting call. I don’t know what it was. But she did not take the pictures.

“Later in the evening I was in jail and I asked my lawyer to try to contact her,” Delaware continues.

According to Delaware his arrest is standard operating procedure.

“They had to because she had a scuff on her arm,” says Delaware. “It’s state law. The cop told me it was total bullshit, they knew she’s full of shit, and it’s going to be thrown out.” No matter. Delaware says it’s $50,000 bail for a domestic violence beef. He was taken to Van Nuys.

“The police treated me very well while I was there,” says Delaware. “The police were very accommodating to me.” While in jail, Delaware already got word that the Adultfyi story was up.

“I couldn’t believe that,” says Delaware. “This is someone who I really trusted. I gave her all my money because I trusted her with it. This girl was my sobriety. This girl was my inspiration. I had a lot of problems in the past and I overcame those and she’s been a help to me. And with all this happening, it broke my heart. I can’t believe that she would do this to me. I trusted her with everything. I would give her anything I had. I feel so betrayed.”Delaware said he was escorted to retrieve Cruz’s belongings.

“I gave back to Derek a bunch of her stuff that she left behind- I know she needs all her expensive dresses.”

Delaware also describes Cruz as an “attention freak.”

“She needs attention so bad,” he says. “I went to K Beech’s birthday party with her and she insisted that Mike Sullivan and TT Boy who were at the house were fighting over her and that Dion has a crush on her and that we should leave because TT Boy looks really jealous because I’m with her. And me and TT Boy- I love TT Boy- I have nothing but respect for him. He’s a great guy. He’s one of the real men in this business, somebody I really look up to. She can never taint the way I thought of him. But she’s always everyone wants to fuck her- all the producers that were at the house- everybody’s trying to fuck me, you can’t leave me alone. Every time you leave me alone somebody tries to fuck me. It’s always this poor me thing and she gets me all riled up.

“I was at the freakin’ grocery store with her. She comes out of the grocery store all mad. I’m like what’s wrong? She’s like this guy disrespected me so bad I want you to kick his ass. I go what are you talking about. She goes this guy was so rude to me, she’s like almost crying. She says, yeah, that black guy. I go over there. There’s like five black guys and they’re all black gang banging black guys. I’m okay, I can beat up any man one on one. I figured I’d take him and two of his friends out. I get up there and start talking to him. These dudes are strapped and the guy is telling me you out of your mind, white boy? I go, dude, you disrespect my girlfriend. I wanted to confront some guy totally risking my life. I was unarmed, a white boy. This girl could have had me killed. I could have been killed there right there in the parking lot totally defending her honor. She needs her ego pumped at all times.”

According to Delaware, he can never go anywhere with Cruz and have a good time because she has to be that center of attention.

“She’s always saying I’m fat- I think she’s very beautiful,” said Delaware. “I melted when I first saw her. I was like oh my God, a chubby little Pocohantas. I fell in love with this chick. There’s nothing in the would I wouldn’t do for her when she smiles. She has the prettiest smile. She’s such a sweet girl to me and this happens. I don’t know if I really scared her because of who I am. I bluffed her. I admit it. I did this to make her feel uncomfortable because she was making me uncomfortable. It was the only thing I could do. I don’t beat chicks. I don’t grab chicks. I don’t choke chicks. I don’t do anything of the sort and she knows goddamn well I didn’t touch her. And I think that’s why she didn’t take the picture because she knows it’s not right. But I’m not putting anything past her at this point.”

For his part, Delaware said he’s willing to walk away from this.

“It’s okay- I’m back on my feet and walking around,” he states. “And that’s what I’m letting her do. I’m not trying to lose her any work. She’s fucking beautiful and everybody knows that. I wouldn’t deal with her if she wasn’t beautiful. But what she’s done really hurt me.”
