Utah- Jim Smith flipped through the DVDs in the family section at FYE Music & Movies in Provo Towne Centre Mall, searching for “Heavy Weights”; instead, he found “Casey the Coed,” which he describes as a pornographic film. “Somebody picked up the film, chickened out and dropped it in the kids’ section,” he said. Smith, a 24-year-old consultant for Lighted Candle Society – a nonprofit corporation that distributes anti-pornography information – told others about the experience, but no one believed him, so he set out to document what he found. During a search of FYE, Smith found adult-themed films filed at child’s eye-level in a heavily trafficked aisle. He also noted the adult section is located to the right of the anime cartoon titles, which contain a number of children’s DVDs. Smith didn’t stop at FYE. He found a display of DVDs produced by Playboy, Hustler and Vivid Video in Virgin MegaStore in Salt Lake City. He said he also found films on display that depicted homosexual relations between adult men and underage boys and missionaries of the LDS Church located just two rows from the family section. “In any state in the union you are going to have a back room for this kind of crap,” said Smith. “Here, there is no back room or back corner for the so-called ‘adult’ material; it is in the center of the store.” Detective Jed Johnson, Salt Lake City Special Investigation Division, sent two detectives to the store June 29. They concluded there’s no reason for the city to take action because the pictures on the DVD cases aren’t overly offensive, he said. “It probably wouldn’t pass any of the tests if it went to court,” Johnson said. “Nothing we saw was out of ordinance.” Salt Lake City Building Services and Licensing Department business license administrator Edna Drake said the city’s policy requires that a “visual barrier” exist between adult-themed films and the rest of the store’s retail floor. But she couldn’t say if Virgin MegaStore is out of compliance because no complaints have been filed. Lighted Candle Society Chairman John Harmer, a former attorney and author of “A War We Must Win,” said he is confident the detectives are well trained, but he disagrees with their assessment. Prosecution would have a strong effect on merchandisers’ attempt to bring adult-themed films into the community, he said, but the city is apparently reluctant to do so in this case. “They are looking for a slam-dunk case,” he said Monday. Virgin MegaStore spokesmen declined to comment. FYE spokesman John Sullivan said that when he heard the complaints, he contacted the local store manager in Provo. “I’m a parent and I know how these people feel,” Sullivan said Wednesday referring to people concerned abut minors’ exposure to adult-themed films. “As a company we take great care in making sure the adult section is not near the children’s videos.” Camille Williams, Provo City assistant attorney, said the police department only investigates a claim if they receive a complaint. To date, she said, they haven’t received any complaints about FYE. Smith isn’t surprised no one has complained. “It’s like an ostrich syndrome,” he said. “They’d rather cover their eyes, keep walking and take care of themselves than take a stand and say, ‘Why is this stuff next to my kids’ movies?’ “Smith plans to include his findings in a documentary he’s been compiling for the past three years with Alex Boye, former member of the British pop band “Awesome.” He said the documentary will discuss the melding of music, pop culture and pornography. The documentary also says there’s a trend of members of the LDS Church and other Christian denominations buying pro-pornography products such as Hustler posters, T-shirts and Playboy products. “They’re buying them at a massive level,” Smith said. Smith said he will start a letter-writing campaign to protest the store displays, but first he wants to finish the documentary to get people thinking about what they buy. “Money is the language of value,” he said. “When you go out and purchase a product, you are telling the person who sold it that you want it in your life.”
