Daytona, Florida- The fight between a strip club and a Daytona Beach anti-nudity ordinance could take center state at the U.S. Supreme Court.
Attorneys for Lollipops Gentlemen’s Club said they filed the petition after a district court refused to rehear a case in which the court upheld the city’s nudity ordinance.
Earlier, a lower court found the ordinance unconstitutional.
The city’s ordinance states if a club sells alcohol, or is within 500 feet of a business that sells alcohol, the dancers must wear modest bikinis.
The city will allow adult entertainment in certain areas, including undeveloped land west of the city.
