Jackson County ponders ordinance to regulate adult businesses

Missouri- Recent alleged sex between men and a teenage girl at an adult entertainment center has prompted Jackson County to consider a crackdown on such businesses.

County Executive Mike Sanders and other officials plan to testify before the county Legislature today about an ordinance Sanders proposed in the wake of reported sexual activity at Erotic City, 8401 E. Truman Road.

Erotic City, in unincorporated Blue Summit, has video booths and a nude dancing bar where nonalcoholic drinks are served.

A man pleaded guilty in federal court Nov. 5 to engaging in unlawful sex with a 14-year-old girl at Erotic City and elsewhere in Missouri and Kansas. The girl alleged in court records that there was an “orgy room” at Erotic City where up to 20 men had sex with her at a time.

Sanders said the federal case and the frequency of calls to the sheriff last year about various incidents at Erotic City prompted the ordinance, although Erotic City was not charged with any offenses.

Neither the lawyer for Erotic City nor a woman who is one of the owners returned a call for comment Friday about the allegations and the proposed ordinance.

The ordinance would be aimed at any adult business in the county that is not already regulated by city codes.

“Unlike any jurisdiction locally or almost any jurisdiction nationally, there are scarcely few regulations of adult industries in rural Jackson County,” said Sanders, the former prosecutor. “We are proposing a broad, sweeping range of ordinances and regulations so we can protect public safety and health.”

Among other things, the ordinance would restrict video booths to one person and prohibit holes in video booth walls where people can make sexual contact, Sanders said. It would also restrict physical contact between nude dancers and customers.

Sanders said the ordinance would require that adult businesses pass inspections for cleanliness, lighting and other concerns. Everyone who works at an adult entertainment business would have to get a license and could have no convictions for felonies or sex-related offenses, Sanders said. The ordinance is patterned after a code Kansas City passed in the early 1990s.

“Clearly, their regulation of this industry has been successful,” Sanders said. “It comports with national trends and regulations.”

Jackson County passed an ordinance in 1992 to restrict use of video booths, but a federal judge struck it down, saying the county did not show a connection between the booths and the spread of sexually transmitted diseases.

Sanders said the county failed at the time to produce enough facts and other arguments for the law. He is more confident this time around. He said testimony is planned today from county prosecutors and private groups about the need for more regulations.
