Madison County settles lawsuit over porn

EDWARDSVILLE, Missouri — A federal lawsuit filed against Madison County by a secretary who said she was subjected to pornography on a supervisor’s computer has been settled out of court.

Madison County Board Chairman Alan Dunstan said Tuesday that continued litigation would have involved additional expenses and uncertainty, and the $100,000 settlement was in the best interests of the county and the employee, Robin Beem.

“The employee whose actions resulted in the lawsuit is no longer employed in county government, and the county is satisfied with the $25,000 settlement and legal fees, and is eager to put this issue behind us,” Dunstan said. He said Beem would get only about $25,000 after attorney’s fees and other expenses.

“I’m glad to have it resolved,” Dunstan said. “We need to move on.”

Beem sued in 2007, claiming she was a victim of sexual discrimination and harassment when her former boss, James Monday, viewed pornography on his office computer. Monday resigned as the county’s director of administration in 2006. She continues to work for the county.

Sheriff’s detectives found pornography on the computer but no evidence of criminal conduct, authorities said.

Beem’s attorney, Lee Barron, said she had shown “courage and integrity in bringing this matter to the public’s attention.” Barron said Beem had “great confidence in the current administration and she hopes to put all this behind her.”

The suit was scheduled to go to trial in federal court in East St. Louis on Jan. 20.

Barron said he and Beem were confident about her likelihood of success at trial but “it would have been extremely difficult for everyone involved.” Barron said the settlement was reached with the help of a third-party mediator.

U.S. District Judge G. Patrick Murphy had ruled in August that Beem had not complained about the conduct until October 2005 and the county would not be liable for any damages she suffered before that time.
