LOCKPORT, NY —Michael A. Drahms, 36, of Lockport-Olcott Road, Newfane, pleaded guilty Friday in Niagara County Court to a misdemeanor charge of third-degree obscenity.
Assistant District Attorney Elizabeth R. Donatello said Drahms, who was arrested in January 2008, exhibited obscene material to a small boy. Defense attorney A. Angelo DiMillo said the boy walked in on Drahms as he was watching a “Girls Gone Wild” DVD and saw a few seconds of it before Drahms turned it off.
Donatello said the DVD qualified as pornography and noted that Drahms had been indicted on a charge of sexually abusing the boy. DiMillo said Judge Sara Sheldon Sperrazza ruled the evidence met the legal standard for sexual abuse only “by the skin of its teeth.”
Sperrazza scheduled sentencing for May 13.
