In an Orange County rape case commented on at length by Selena and Kent Silver, www.selenasilver.com on KSEX, www.ksexradio.com Wednesday night, a doctor is now saying that it was all consensual.
Porn Valley- A girl who was allegedly gang-raped by three teens in a videotaped attack said the unprotected sex was consensual and asked for a morning-after abortion pill, a doctor testified.
Dr. Elvira Whiteford also testified Wednesday that she didn’t find any injuries during a pelvic examination she performed on the girl a day after the 2002 incident.
The doctor said that she asked if the girl had been sexually assaulted, and the girl said “that there was no foul play and she was not put in jeopardy.”
Whiteford’s notes from the examination indicated that the girl, then 16, “denies rape — willing partner.”
“She got caught in another lie,” defense attorney Joseph G. Cavallo said outside the Orange County courtroom.
On Tuesday, a defense expert testified that the woman may not have been unconscious during the alleged assault, as she contended.
Dr. Harris Fisk, a neurologist at Cedars-Sinai Medical Center, testified that the 20 minutes of video show the girl moving her legs, rolling onto her side and brushing her hair out of her face at least nine times.
“The individual is capable of sensing her environment,” Fisk said. “She appears to be in a lower level of consciousness than she actually is.”
Prosecutors contend that the Rancho Cucamonga girl was given a drugged drink that made her pass out on a pool table, where she was raped and assaulted with a bottle, a pool cue and a lit cigarette.
Defense attorneys maintain the girl, now 18, aspired to be a porn star and was pretending to be unconscious during the taping.
Kyle Nachreiner and Keith Spann, both 19, and Gregory Haidl, 18, face up to 55 years in prison each if convicted of 24 sexual assault charges. They are free on $100,000 bail.
Prosecutors alleged that the attack took place at the Corona del Mar home of Haidl’s father, Orange County Assistant Sheriff Don Haidl.
