from www.ocregister.com – Greg Haidl and two other men convicted in a high-profile sexual assault case will remain registered sex offenders.
The state Supreme Court on Wednesday denied the men’s request for a review of lower panel’s decision that upheld their March 2005 conviction in Orange County Superior Court.
Haidl, 25, Kyle Nachreiner and Keith Spann, both 26, were sentenced to six years in prison in 2006 after being convicted of multiple sex felonies regarding a July 2002 videotaped sexual encounter. They are all out of prison, having to serve half of their six-year sentences because they were not convicted of forcible sex counts.
The assault was filmed at the Corona del Mar house of Haidl’s father, then-Assistant Sheriff Don Haidl. The videotape shows the men, who were juveniles at the time, laughing and engaging in group sex with the then-16-year-old Jane Doe, who appears to be unconscious. They also insert foreign objects into Jane Doe, including a pool cue, a Snapple bottle and a lit cigarette.
Besides serving time behind bars, they also were ordered to register as lifelong sex offenders. They appealed to the 4th District Court of Appeal in Santa Ana, arguing that the sex offender label was too harsh given that they were juveniles at the time of the crime. The men were tried as adults.
The appeals court upheld the men’s status, citing a hearing given by the state court judge that found the trio unfit to be tried as juveniles.
Haidl’s appellate attorney, Dennis Fischer, filed the joint petition. He could not be reached for comment.
