Lawsuit of the Day: Evan Seinfeld, Lupe Fuentes Being Sued in Copyright Infringement Case

Good thing The Kingsmen, Mitch Ryder & The Detroit Wheels plus The Righteous Brothers aren’t around or else there’d probably be a lawsuit over the humming of the song, Little Latin Lupe Lu.

But with the current copyright legal winds blowing such as they are, Evan Seinfeld, Lupe Fuentes and Webquest do find themselves embroiled in an infringement suit involving the use of “Little Lupe.”

The suit was filed at U.S. District Court in Los Angeles by the operators of the Teen Revenue affiliate program claiming its copyrights of Fuentes were misappropriated.

According to a story reported by www.xbiz.com, Teen Revenue’s Paolo Cammarata says that when he met Fuentes nearly four years ago, he coined her name and constructed the website littlelupe.com after entering into a deal with her.

The lawsuit states that this website has been over the last three years one of the most profitable in the Teen Revenue program.

But when Seinfeld began managing and promoting Fuentes, he later registered the sites LupeFuentes.com and ILoveLupe.com, with the alleged intent “to misappropriate the fame and goodwill associated with the mark ‘Little Lupe.’”

Seinfeld and Lupe Fuentes LLC partnered with WebQuest in the development and management of the sites, the suit goes on to say. WebQuest promotes the websites through its ColdHardCash.com affiliate program.

Besides all that, what also draws Webquest into the frappe is that webmaster Evil Chris, aka Chris Rogers, was once an employee of Teen Revenue but is now with Webquest.

Seinfeld allegedly provided at least 50 stolen videos from Little Lupe.com with false copyright information to WebQuest, which copied, uploaded, then displayed and distributed the videos on ILoveLupe.com; and it was Rogers who apparently tipped the hand by bragging on GFY.com that the new ILoveLupe.com site included her historical content.

The suit also names processors NETbilling and Local Billing, which allegedly processed transactions for LupeFuentes.com and ILoveLupe.com.

The suit seeks actual damages of not less than $1M

The attorney for Teen Revenue is Jay Spillane. Seinfeld’s attorney is David Beitchman.
