Bernie Madoff, USA – from www.examiner.com – Say it ain’t so Doc! Dr. J. aka Julius Erving is in legal trouble after being accused of cheating a woman out of 420K.

Mary Gilbert of Manhattan has filed a suit that charges Dr. J. with “breach of contract and fiduciary duty”. Ms. Gilbert seeks both restitution as well as “pre-judgement interest” and punitive damages.

Ms. Gilbert asserts that Dr. J. along with infamous and disgraced deal broker Kenneth Starr conned her into making a substantial investment in a limited partnership known as Commonwealth Investors.

Allegedly Mr. Erving promised Ms. Gilbert a full one third of his investment returns on the deal. However he made almost 3 million dollars with her money. Gilbert’s lawyers contend that Erving “concealed the true amount of the distributions that Erving received and falsely reported to Gilbert the share of partnership distributions that should have been paid over to Gilbert”.

The alleged scam was uncovered by Ms. Gilbert following Starr’s arrest last year. Starr is also currently awaiting sentencing for a 50 million dollar ponzi scheme.

Julius Erving’s lawyer has not yet commented on the suit filed against him.

Dr. J. is considered a legend in the Philadelphia area and a conviction in this matter would surely tarnish his image.
