Update: TMZ Included in Rozlyn Papa Lawsuit

Los Angeles- from www.dailybreeze.com and www.xbiz.com – A former contestant on “The Bachelor: On the Wings of Love” Rozlyn Papa can pursue her $1 million lawsuit against several web sites for falsely identifying her as an actress in a pornographic video, a judge ruled today.

Los Angeles Superior Court Judge Debre K. Weintraub rejected arguments by lawyers for pornhub.com, peeperz.com and the other sites to dismiss the claim. According to additional info provided by www.xbiz.com those other sites were the Mansef-owned PornHub.com, KeezMovies.com, Tube8.com, Peeperz.com and ExtremeTube.com.

Also named in the suit were mainstream media outlet TMZ and adult sites JuggCash.com and Brazzers.com, owned by Mansef Inc.

Papa filed suit at Los Angeles Superior Court over allegations that a number of companies falsely advertised that she was the lead actress in Lexington Steele’s “Pole Position: Lex POV.”

In March, Steele told XBIZ that the video of the performer in the tape wasn’t Papa but another actress — Lucy B.

While Papa was mistakenly identified, the judge ruled that the article accompanying it, called “Rozlyn Papa’s Sex Tape,” was protected free speech.

In her court papers, Papa said the postings caused her mental anguish and lost revenue, as well as a damaged reputation. After the hearing, her attorney, Roderick J. Lindblom, said his client lost job opportunities because of the video.

In a sworn statement opposing the dismissal motion, Papa states the assertion she was *the woman depicted in the video caused “irreparable damage and injury to my public image and reputation, which is a major basis for my employability in my chosen field.”

Papa says the damage goes beyond her personal status.

“I am a single mother to a 7-year-old son and. aside from the irreparable damage already done to me … their web site has caused … irreparable damage and injury to my son,” she says.

The blog entry Papa alleges was defamatory touts the actress’ alleged appearance in the video.

“Way to go Rozlyn, look at all you’ve accomplished,” the blog’s author states. “Forget 15 minutes of fame. We see big things in Rozlyn’s future. The options are endless.”

Papa was removed from fourteenth season of “The Bachelor” after host Chris Harrison confronted her about an alleged relationship she had with producer Ryan Callahan, who was fired. Papa denied any wrongdoing.

Papa is seeking damages for lost income, invasion of privacy, lost reputation and mental anguish, according to her attorney, Roderick Lindblom.
