Depending whose opinion you solicit, those changes depend on that proposed 17 page draft proposal of Cal/OSHA rules and regulations regarding barrier protection. If and when they’re adopted, and it’s more a matter of when at this stage, they’ll fundamentally change the adult industry, and the way the adult business shoots sex scenes.
The bigger companies will have to comply. Some companies may go “underground” wherever that is. Some companies will go out of business. Some companies may move. Some companies may just buy content from European producers. And some companies may move to Europe.
It all depends how important non-condom sex scenes are to your company and how much you stand to lose by integrating condom scenes in your product line.
Can or will Hustler pick up and move to another state? Probably not. Before the new regulations are adopted by the State, however, they’ll have to be approved by Federal OSHA.
Though that topic wasn’t specifically addressed at Tuesday’s meeting or perhaps made more clear than it is, it’s on the table and in effect. But the Federal idea was touched upon at the meeting and the advisory made that these regulations could be adopted as a national standard.
Meaning, essentially, no matter where Big Porn moves, these regulations will necessarily follow. You can run, but you can’t hide.
If another state wanted to adopt these regulations, they’re already considered approved and ready to be set in force. Yeah, let’s all move to Nevada.
The only way to escape pending regulation would be a move overseas.
Cal/OSHA isn’t forcing this issue so much as the Aids Healthcare Foundation, which is a well organized, well financed agency and knows how to play the game. Big Porn doesn’t. While the state isn’t trying to help the industry, neither is it trying to force it out of business. It’s just caught in the middle of a gigantic tug-o-war between Big Porn and the Aids Healthcare Foundation.
But since the issue has gained so much national attention, there’s no alternative but to push forward with the Cal/OSHA regs which will likely cut down on work in Big Porn. No question.
The way the rules work are these: barrier protection for anal and vag, no exceptions.
For oral, Cal/OSHA is willing to make an exception and say that if the girl has a Hep B vaccination and has a clean STD test within two weeks of the shoot date then she can do oral without a condom. I know. Beyond complicated. Before this is all over, you’re going to need the combined NFL Referees and Major League Baseball Umpires Associations, a whistle and a set of foul lines to determine when a ball is in play.
