BOULDER, Colo. — from www.thedenverchannel.com – Attorneys choosing a jury in Boulder District Court are asking prospective jurors if their opinions on pornography would affect their ability to act fairly in a burglary case.
Police accused 42-year-old Theodore “Teddy” Lopez of breaking into the Mile High Adult Center and stealing pornographic magazines on Sept. 18. He is charged with felony burglary, misdemeanor theft and misdemeanor criminal mischief.
According to the Longmont Times-Call, prosecutor Ken Kupfner asked potential jurors on Wednesday if their personal feelings about pornography would make it difficult for them to regard the business as a victim.
Kupfner also told the jurors that the case is about burglary and theft, “not a referendum on pornography,” the newspaper reported.
One potential jury member told the Longmont Times-Call that she believed she could be fair, but that she couldn’t check that emotion. The woman also said she had watched a special about destruction caused by pornography. She was placed on the jury.
Another potential jury member said that theft is wrong, but he would have a problem protecting a porn store, according to the newspaper.
In all, three jurors said they were conflicted on the issue and one was put on the jury.
Lopez is scheduled to begin his trial on Oct. 17
