L.A. Firefighters Won’t Face Discipline in Porn-Film Probe: Statute of Limitations

from www.latimesblogs.latimes.com – Los Angeles firefighters who allegedly allowed fire engines to be used in two porn films won’t face discipline because of a loophole in the City Charter, officials said Tuesday.

The charter prevents the Fire Department from disciplining any member for actions that are more than two years old, Chief Brian Cummings said in a letter to Councilman Dennis Zine. The chief said both incidents occurred on or before 2008.

One incident involved Engine 263, which is stationed at Firehouse 63 in Venice. The truck was used for a film starring adult actress Charley Chase at Venice Beach, where she was seen climbing on the vehicle and exposing herself.

The other film involved Engine 41, which is quartered at Firehouse 41 in Hollywood.

Zine received the letter after requesting an update on the investigation. He said Tuesday that he had met with Cummings and was told that the department would continue its investigation of the incidents, but that no actions could be taken against firefighters who may have been involved. Cummings and Mayor Antonio Villaraigosa had called for disciplinary measures if the allegations were true.

“There’s no discipline they could administer,” Zine told The Times.

He said he would explore changing the City Charter to create a provision for the Fire Department that is similar to one for the Los Angeles Police Department. That provision allows the time frame on the statute of limitations to begin when an incident is discovered, not when it occurred, Zine said.

The porn shoots, which were first reported by NBC4, were discovered by the Fire Department after the films were spotted on the Internet and someone alerted fire officials, Zine said.
