from www.jacksonsun.com – Amy Lynn Howell, an English teacher at Chester County High School, was arrested Wednesday on the charges of sexual battery by an authority figure and statutory rape by an authority figure, according to jail records. Howell was released on $10,000 bond and school officials on Thursday said she has been suspended without pay.
Chester County Superintendent Cherrie Pipkin said someone told her late Tuesday that a teacher had engaged in inappropriate conduct with a student and that she reported what she heard to the Chester County Sheriff’s Department on Wednesday morning. That led to an investigation by law enforcement authorities and Howell’s arrest.
“Allegations of misconduct were reported to me regarding a teacher and a student,” Pipkin said Thursday. “The authorities were notified immediately, and the Chester County Sheriff’s Department conducted an investigation that led to the teacher being charged, and the teacher has been suspended without pay.”
Pipkin would not name the teacher involved in the incident, but Howell’s involvement was confirmed later by the sheriff’s department.
Sheriff Blair Weaver said Howell was booked into the Chester County jail at around 3 p.m. Wednesday. He said she was arraigned Wednesday afternoon.
Statutory rape by an authority figure, according to state law, occurs when sexual penetration takes place between a victim that is at least 13 years old but less than 18 years of age and a defendant who is at least four years older than the victim. The law states that the defendant, at the time of the offense, was in a position of trust or had supervisory or disciplinary power over the victim by virtue of the defendant’s legal, professional or occupational status and used the position of trust or power to accomplish the sex act.
If a defendant has parental or custodial authority over the victim and uses the authority to accomplish the sex act, the situation also is considered statutory rape by an authority figure.
Statutory rape by an authority figure is a Class C felony and no person who is found guilty or pleads guilty to the offense is eligible for probation or judicial diversion.
Sexual battery by an authority figure occurs when an unlawful sexual contact takes place involving a victim who is at least 13 years old but less than 18 years of age, or the victim was, at the time of the offense, mentally defective, mentally incapacitated or physically helpless, regardless of age.
This is also the case if the defendant had a position of trust, or had supervisory or disciplinary power over the victim or if the defendant had, at the time of the offense, parental or custodial authority over the victim and used the authority to accomplish the sexual contact.
Sexual battery by an authority figures is a Class C felony.
Howell, 37, could not be reached for comment Thursday night, and the sheriff said he did not know when she will appear in court again.
