from bismarcktribune.com – A former Hebron High School teacher is accused of sexually assaulting two boys and providing alcohol to them and two others.
Jennifer Katherine Schultz, 25, was charged Wednesday with two counts of Class C felony sexual assault, Class A misdemeanor corruption or solicitation of minors and Class A misdemeanor delivery of alcohol to minors.
Schultz made her first court appearance in the case at the Morton County Courthouse on Friday with her attorney, Stormy Vickers. South Central District Judge Gail Hagerty set bond for her at $5,000 cash or surety and ordered her to remain in North Dakota or Clay County, Minn.
Schultz pleaded not guilty to the misdemeanor charges. If convicted of the sexual assault charges, Schultz will be required to register as a sex offender.
Four students – a 16-year-old, two 17-year-olds and an 18-year-old – went to Schultz’s home in Hebron early in the morning on Oct. 15, and Schultz let them in, according to an affidavit from Morton County Sheriff’s Deputy Tom Sharp.
The boys asked Schultz if she wanted to take shots with them, and she provided them with a bottle of Blue UV Vodka, Sharp’s affidavit said. After drinking, two of the boys, 18 and 16 at the time, left with the vodka, it said.
The other two boys, both 17 at the time, went to Schultz’s bedroom and lay down to sleep, Sharp’s affidavit said. It said Schultz lay between them and kissed both of them.
Schultz had sex with one of the boys while the other boy was on the bed, according to the affidavit. The boy with whom she allegedly had sex then lay on the floor, and Schultz asked the other boy whether he wanted to have sex, the affidavit said. The boy said no, and Schultz began fondling him, the affidavit said. The boy told her to stop, and she did, the affidavit said.
The other two boys returned later in the company of a teenage girl. The affidavit said Schultz was angry with the boys for bringing the girl and said she couldn’t come in. The girl threw the bottle of vodka out of her car and drove off.
The boy with whom Schultz allegedly had sex left her home at approximately 7 a.m., according to the affidavit. The other three left at approximately 8 a.m. out the back door after Schultz told them to leave, Sharp said.
“Later that day, (one of the boys) received a text message from Ms. Schultz telling him that if anyone saw the boys leaving her house in the morning to say they were there watching her dog,” Sharp’s affidavit said.
Schultz was a teacher at Hebron High School, Sharp said in his affidavit.
Kevin Nelson, superintendent of Hebron Public Schools, said the school received a complaint about the incident in November, and Schultz was placed on paid administrative leave the same day. The district began investigating and Schultz resigned during the investigation, Nelson said.
Morton County Assistant State’s Attorney Jackson Lofgren and Vickers jointly recommended the $5,000 cash or surety bond set by Hagerty. Lofgren said Schultz came to Mandan to face the charges without the state having to serve a warrant and go through extradition to get her from Hawley, Minn., where court documents say she is now living.
Schultz agreed to waive extradition to North Dakota and provide a photo and fingerprints to the Morton County Sheriff’s Department.
Vickers asked Hagerty whether the bond could include a provision to pay 10 percent of $5,000 rather than $5,000 cash or surety. Hagerty typically will not grant anything but cash-only bonds, and she refused Vickers’ request.
“It is a very rare thing that I will give anyone a surety bond,” she said.
“This is a real change for me.”
