Cincinnati- There is now an official legal action asking for the removal of Hamilton County Prosecutor Mike Allen from office.

Community activist Carrie Davis filed a complaint in Hamilton County Common Pleas Court Tuesday.

“Regrettably, the recent actions of Michael K. Allen and his inability to see beyond his own ego as to the necessity to resign, I take the following actions in order to spare the community unreasonable delay in fulfilling the public outcry for his inevitable removal,” reads the complaint.

A private citizen does have the right to appeal to the court to have a public official removed from office.

Mike Allen’s wife, Lisa, is a judge at Hamilton County Common Pleas Court.

CINCINNATI — For the first time since news of Hamilton County Prosecutor Mike Allen’s affair with assistant prosecutor Rebecca Collins, Allen’s wife spoke out.

Although Lisa Allen, who is a municipal court judge, is only speaking out now, she said she has known about her husband’s affair for a few years, WLWT News 5 reported.

And she said she found out about it from the “other woman” — Collins — who left a package on Allen’s car in February 2001.

Lisa Allen said the now public scandal is taking a toll on her children. She and Mike Allen are still together as husband and wife, but she said she doesn’t know what the future holds, especially with the lawsuit being filed and more details about to become public.

“Let me put it this way: He’s a grown man. I’m a grown woman,” Lisa Allen said. “I have children (and) they come first. There is where my focus is now. I love my husband. I care for him and I care what happens to him.”

Lisa Allen said she does not believe Mike Allen should resign his office or take a cooling-off period with the lawsuit pending, WLWT reported. She said he’s been doing his job for a few years while the couple has been working through this with the help of counseling.

Randy Freking, Collins’ lawyer, said his client is sympathetic to the Allens’ situation, but added that Lisa Allen is not considering the whole story.

“Lisa Allen is ignoring the last six to eight months, in which — after Mr. Allen reconciled allegedly with Lisa — he continued to pursue Rebecca at work, continued to attempt to engage in sex with Rebecca at work, continued his pursuit contrary to what he has told the media that ended last August of 2003,” Freking said. “It did not end from his standpoint last August. Rebecca said no last August. He has continued to pursue (her for) the last year.”

Freking said he will be filing an amended complaint with new allegations, stating that it’s a violation of Ohio law to retaliate against someone who has filed a lawsuit against her employer.

A representative of the prosecutor’s office said that work has not been taken away from Collins; it has just been reassigned in her absence.

Also Tuesday, a new lawsuit was filed, asking that Mike Allen be removed from office.

Carrie Davis said Allen’s affair amounted to willful neglect of duty and misconduct by his office.

Davis alleges that the affair violated Allen’s own office policy, and has potentially made Hamilton County tax payers liable.

Mike Allen and his lawyer have yet to comment on the lawsuit
