from www.readingeagle.com – A 2005 Twin Valley High School graduate who became a high school teacher in South Carolina has been cleared of charges she had a sexual relationship with a male student for several months, according to court records.
Abby Kate McElhenny, formerly of the Honey Brook area, was arrested in June 2011 and charged with sexual battery of a student at Boiling Springs High School in Spartanburg County. The charge was dropped Dec. 18, according to court records.
Spartanburg County Sheriff Chuck Wright said in 2011 that McElhenny’s relationship with the student began about Christmas 2010 and ended in May 2011. Officials did not disclose the age of the student.
The age of consent in South Carolina is 16. However, McElhenny, a Spanish teacher and varsity swimming coach at Boiling Springs, was charged under a state law passed in 2010 that made it illegal for a teacher to have sexual contact with any student under age 18.
Without that law, McElhenny would not have been charged. Wright said the student’s parents signed a waiver of prosecution and did not want criminal charges filed against her.
If convicted, McElhenny, who remained free on bail, would have faced up to five years in state prison.
Neither McElhenny nor her family members could be reached for comment Wednesday night.
Wright said in 2011 that a relative of the student told authorities about the relationship between the boy and McElhenny.
Wright also could not be reached for comment Wednesday.
McElhenny resigned from the high school in May 2011, district officials said. She was hired in August 2009 after earning a degree in secondary education from Clemson University in South Carolina.
The district conducts reference and background checks on all employees.
McElhenny was an honors student at Twin Valley, where she participated in several clubs and sports, including band, track and field, cross country and swimming.
