Attorney Michael Fattorosi tweets: âAccording to Judge Pregerson [pictured] requiring condoms is not unconstitutional but he made enforcing them almost impossible.â
Wrong, wrong, wrong, wrong, wrong. Enforcing this ordinance is way too easy and attorneys like Fattorosi are completely missing the obvious.

âAmazing that no oneâs talking about the condom law- something that is so prevalent in the business is swept under the rug,â said Black.
âPeople are silent on the issue that would effect every performer out there. AVNâs not talking about it. No oneâs talking about it.
âOn the books, the judge has stated plain and simple that you got to wear a condom on a porn set.
“There are fines, penalties and things coming down that will be levied against performers and studios if these rules are not followed. If the talent is working and they get a violation because they broke the law- who pays for their lawyer?
“Is the industry going to create a new revenue stream with Cambria, Gelbard, Fattorosi- is that going to be the new revenue stream for the business? Back in the Eighties the gimmick was that video stores needed lawyers on retainer who never helped anybody.
âOn the books it is illegal- perform in a sex scene without a condom- you are cited for a misdemeanor violation where you have to go to court and itâs on your record.
âWho pays for that? The agents put you in a position where you have to defend yourself. You make the entire system money, except the porn performers. Way to go. I guess I see exactly what theyâre doing. In a million years how do you tell somebody donât worry about the condom ordinance [when talent has to pay the fines].
âAs this evolved, every scene you do- they [the authorities] donât have to stake out the house- all they do is systematically go through DVDs to find violations.
âHow are you people listening to Steve Hirsch, John Stagliano and LATATA? I donât get it. As this gets sorted through and they put out fines and penalties- all they [the city] have to do is sit back and collect their money. Somebodyâs getting taxed.
âYou donât want to work within the industry now, youâre going to pay the city with fines. They donât need to get you for a condom violation permit. All they have to do is say $1,000 fine- fuck you. You guys are getting taxed on fines and the outgoing process. Youâre going to have all the talent with misdemeanor tickets, and theyâre going to have to pay the Fattorsis then pay the city.
âI donât get where you guys see a silver lining in this picture,â said Black.
âThere ainât no silver lining, guys. The city doesnât have to do a thing except hire two people in an office and they go through porn DVDS- violation, violation, violation. And thatâs it. Nobodyâs got to stake out porn sets or kick down doors except sit, get fat grow old and die. Thatâs what a city official does. They can sit there all day and watch fuck movies and present their money ledger. âWe could do this all day.â

If they have tweets you are so fucking done itâs pathetic. If during a live feed thereâs no condom use, the police donât need a warrant if they are actually watching the crime being committed.
