Hollywood- It was an unforgettable moment as Jamie Foxx accepted the Academy Award for his starring role as Ray Charles in “Ray.” But behind the scenes, “CJ” has learned that a secret deal is in the works to keep the public from seeing some very private images of Foxx: some 90 personal photos including some that show the Oscar winner naked and in sexually explicit situations. The photos somehow found their way from Foxx’s Las Vegas home to a photo broker who wants to cash in.
That broker, David Hans Schmidt, told “CJ” on Monday that Foxx’s Oscar win makes the photos extremely valuable. He claims he’s been offered more than a million dollars for the Foxx collection.
But Schmidt now claims he is negotiating with Foxx’s lawyers, and sources tell “CJ” that both sides are ready to make a deal for the return of the photos to Foxx.
In January, Schmidt showed “CJ” the photos. Many are innocent snapshots of Foxx with friends and associates, but Schmidt says about a third of them are sexually explicit. “He (Foxx) could be mortified, or proud,” Schmidt said.
Schmidt claims he got the photos from a Las Vegas man named Mark Fithian. According to Schmidt, Fithian claims he found them in a dumpster adjacent to Foxx’s Las Vegas home. Fithian is suing Foxx, claiming in the lawsuit that two men sent by Foxx assaulted him while trying to get the photos back. Foxx denies those claims and has filed his own counter-suit against Fithian.
Now that the photos are about to be returned, will Schmidt have a big payday? Schmidt isn’t saying, but in January he told “CJ” that he’d return the photos if he found out that they were stolen.
“If we come to the conclusion that if it wasn’t acquired legally, then the only righteous thing to do of course is to give the pictures back to Mr. Foxx personally,” Schmidt said.
