Arnold from OPD reponds: When product doesn’t sell as well as expected decisions have to be made. These decisions are not easy as sometimes they involve ceasing business with a friend.
Uncle Lanny product wasn’t a great a line for me, I am being kind here by saying great, it was barely a good line for me.I am more than happy to stop all distribution of Yes Dude, llc and move on. As of this morning, I have sent Mr Mitchell a check for all monies owed to Yes Dude, LLC and a full accounting report on where I got these #’s and all remaining dvd’s currently in stock.
When over 2000 units are sold of one title for a average price of over $9 and 800 and change are returned as overstock months later, this is a good indication that the line needed to be dropped.
I admit fault with not terminating this agreement in a timely manner, and for this I apologize. yet as of 4/19/06, all has been resolved and paid up in full.
Time will only tell if Mr Mitchell decides to admit to this fact in the same manner in which he brought this to my attention, I would like to state that at no time before this was any mention of said action brought to my attention. Once the check has been deposited and cleared, I will be more than happy to do this for him.
Repeatedly, I tried to work with Mr. Mitchell concerning quality of his titles, all my efforts were to no avail.
I also would like to state, that I was given raw footage, no images and an idea to work with to make these movies, We did the editing, artwork and authoring at no cost to Mr Mitchell or Yes Dude, llc. This alone was a breach of contract that I was willing to look past, as I believed that with time and effort, we and I truly mean we could have made his product a much better sellable dvd than what I was given to sell. OPD charges $2500 to Edit, Author, do menu’s and box cover for projects such as this.
I would like to state here, simply that titles were sent to VOD companies, but the agreement that Mr Mitchell signed does not exclude VOD rights in this distribution contract. OPD was contracted to distribute all movies from Yes Dude,llc in any manner including VOD, after doing a quick look into the sales via the VOD method, I found that not one minute was downloaded from hotmovies.com through OPD’s account. All other vod companies have been instructed to cease all downloads from OPD as we are moving towards an exclusive deal with a VOD company. This action is months old already. I find it comical that such companies as adult rental, amore tv are mentioned in this letter I am responding to, since I have not done one cent of business with either of these companies as of yet. We have talked about doing business but none of my titles are downloading from either of these sites currently.
To Mr Mitchell, I apologize for this situation.
I can only sell what sells once given the opportunity I give it with the stores and distributors that I deal with. It all comes down to the quality of the product on the day it was shot.
This goes for every other producer in the market, don’t be to quick to blame the distribution company if your product doesn’t sell. I am still stuck and I truly mean stuck with over 1000 units of a title called American Blow Job Queen with Summer Haze that unfortunately I already paid for to Craig Valentine that I couldn’t give away for free if I tried. Right now I have tons of coasters for my house with an ugly woman on them.
