Augusta, Georgia- An adult bookstore that took Augusta officials to federal court last year to get a business license has had that license revoked.
Augusta commissioners voted 8-1 this week to close down Augusta Video X-Mart.
Last year, commissioners denied X-Mart general manager Jimmy Cassandro a business license, saying the stores location near a busy intersection violated the citys adult entertainment ordinances.
X-Mart took the matter to U.S. District Court and was granted a temporary injunction. The federal court allowed the store to open in January, requiring the city to award X-Mart a business license.
City attorneys appealed to the U.S. Court of Appeals 11th Circuit and won.
With God, we can win this battle, commissioner and pastor Bobby Hankerson said at the Tuesday hearing, which drew about 100 opponents of the bookstore. We do not want this kind of activity in our city.
X-Mart attorney Tom Maddox said the bookstore will appeal and challenge the constitutionality of Augustas adult entertainment ordinances.
