From www.nypost.com – A Manhattan federal judge said [yesterday] that it’s “preposterous” that former Playboy Playmate Anna Nicole Smith would have watched her ex-boyfriend and lawyer engage in gay sex.

Judge Denny Chin, hearing arguments stemming from a motion from TV reporter Rita Cosby to dismiss a $60 million libel suit against her, said an alleged sex tape featuring Smith’s former boyfriend Larry Birkhead and lawyer Howard K. Stern wouldn’t have done much for Smith.

“One point that I find troubling is that Anna Nicole Smith would entertain herself by watching this videotape,” said Chin.

The tape, which lawyers told the judge does not exist, is part of a lawsuit brought by Stern against Cosby, a former MSNBC anchor.

Stern claims that 19 passages inside Cosby’s book, “Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death” are untrue and defamatory.

Stern’s suit also names publisher Hachette Book Group USA.

The suit asks for compensatory and punitive damages.

The book also alleges that Stern and Birkhead struck a deal — Birkhead would get custody of his daughter Dannielynn in exchange for Stern being named executor of Smith’s estate.

Cosby’s lawyer Elizabeth McNamara argued that Stern’s reputation “was in tatters” long before the book was released in 2007 following Smith’s death.
