from www.denverpost.com – Federal prosecutors are appealing a magistrate judge’s decision to let the former owner of a Denver strip club out on bond because they say he was in possession of military explosive devices, ecstasy and a kilo of heroin.
Lance C. Migliaccio, who is the former owner of La Boheme, was indicted in June on four counts of possession with intent to distribute Ecstasy.
At a detention hearing earlier this week, U.S. Magistrate Judge Michael Hegarty granted Migliaccio a $50,000 bond, but stayed his release while federal prosecutors appeal the decision. A hearing is set for Aug. 24.
In granting bond, Hegarty said Migliaccio has strong ties to the community and added additional restrictions such as GPS home monitoring.
“…The Government produced evidence of Defendant’s possession of particularly destructive, military-type ammunition and explosives but no evidence that he, or anyone associated with him, had ever used, or even intended to use or contemplated using, these in a criminal way (although, admittedly, mere possession of such items appears to be illegal),” Hegarty wrote.
Based on an August search, however, prosecutors believe Migliaccio is a risk.
“…Law enforcement learned that this known drug dealer was also harboring a huge cache of stolen military explosive weapons that could cause mass, lethal damage to the community,” they wrote. “the evidence seized from the defendant’s home revealed for the first time that he was also a dealer of extremely large quantities of heroin.”
