Novi, Michigan — www.detnews.com- An Oakland County commissioner charged with indecent exposure after he and a woman were found naked on a city street last month is expected to receive some form of probation, according to a statement released Friday by the district judge who is handling the matter.
Commissioner Kim Capello, R-Novi, was charged after an April 18 incident near the city’s Main Street. An officer was directed to the area by a resident who believed they were involved in a sexual act.
The officer found them up against a 3-foot brick wall near a sidewalk, their clothes on the ground, authorities said. Capello, 56, and the 37-year-old Novi woman admitted they had been drinking before the 2 a.m. incident, police said.
Capello and the woman — who has yet to be arraigned — are charged under a city misdemeanor ordinance, punishable by up to 93 days in jail and fines. But according to a statement released by Novi District Judge Dennis Powers’ office Friday, Capello pleaded guilty at his arraignment Tuesday, which will likely result in probation.
“The matter was taken under advisement upon request of the prosecutor that the plea will be accepted at the time of sentencing. And if terms of probation are completed successfully, the matter will be dismissed,” Powers said in a statement.
Capello, an attorney and former Novi city councilman, is free on personal bond but must return to court for sentencing on June 3.
Powers will determine what form of sentence is appropriate. Judges often provide alternatives, including counseling and community service.
Neither Capello nor his attorney have returned repeated phone calls and e-mails for comment.
In a statement published in The Oakland Press, Capello apologized, saying he was “embarrassed and ashamed.”
“It’s bad enough to do something stupid, I did it in a way that shamed my family, my friends and colleagues here on the commission,” the statement said.
