LEXINGTON, Ky. – City building inspectors have given the operator of a Hustler Hollywood store until Thursday to remove sexually oriented adult material from its shelves.
The city inspected the store Monday after Jimmy Flynt, the brother of Hustler magazine publisher Larry Flynt, said the store would begin selling adult material. On Tuesday, a city inspector dropped off a letter at the store that detailed the violations and said it had 48 hours to “correct” them.
According to a zoning ordinance passed by the Lexington council shortly before the store opened, adult bookstores, adult video stores, adult cabarets, sexual entertainment centers and adult dancing and entertainment establishments are prohibited at interstate highway exchanges in Fayette County. The Hustler Hollywood store, which opened July 16 without adult materials, sits near an interchange off Interstate 75.
The store’s violations include “the display and sale of merchandise that is prohibited” and “items that fall within the definition of adult bookstore or adult video store,” according to the city’s notice to the store.
If the store does not remove the items, Jimmy Flynt could be subject to legal action, said Dewey Crowe, the city’s deputy director of building inspections.
Flynt sued Lexington in federal court Friday, saying the city’s government had violated his constitutional rights. He has asked the court to declare the zoning ordinance as unconstitutional.
U.S. District Judge Karl Forester will hear a request by Flynt on Friday for a temporary restraining order that would allow the store to continue selling sexually oriented adult material.
