CINCINNATI from www.courthousenews.com – A gunshot victim claims he was assaulted and battered by a transvestite nurse who sat on his legs, painted his mouth with lipstick, “kissed him intimately on the mouth and grabbed and squeezed his penis” for “several minutes,” as he lay helpless on a hospital bed.

Dereco Evans says he had emergency surgery at University Hospital for a gunshot wound to his leg on Feb. 11, 2009, which left him “incapacitated and confined to his hospital bed.”

Evans, whose present address is a prison, says he “was classified as an AKA patient and placed on a restricted floor and was told there would be restricted security.”

Nonetheless, he says, while he lay there “incapacitated and confined to his hospital bed … [with] wound vacuums to facilitate the healing of his open surgical wounds,'” Chad Thrasher [pictured] entered, “dressed as a female even though Chad Thrasher is male.”

According to the complain: “Chad Thrasher entered Dereco Evans’ hospital room and, while using sexually explicit language, grabbed Dereco Evans’ face, confined Dereco Evans’ to his bed by sitting on his legs, applied lipstick to Dereco Evans’ mouth, kissed him intimately on the mouth, and grabbed and squeezed his penis. This behavior lasted for several minutes.

“Dereco Evans attempted to reach a call button and summon help but could not reach it because of the way Chad Thrasher had confined Dereco Evans.

“Dereco Evans faked a sudden heart problem and breathing problems causing Thrasher to immediately release his hold on Dereco Evans.

“Dereco Evans was then able to reach the call button and summon help and Chad Thrasher left Dereco Evans’ hospital room.

“One of the nurses responded and reported the incident to University of Cincinnati Police.”

But Evans says the police officers “accused Dereco Evans of lying about the incident and attempted to intimidate him by threatening to arrest him for making the complaint.”

He adds: “The responding University of Cincinnati Police officers accused Dereco Evans of knowing Chad Thrasher’s true danger all the time.”

Evans says he was released 10 days later “and received no further communication from University of Cincinnati Police regarding the incident.”

Evans says he asked the Cincinnati Police to investigate, but they bounced it back to the university police.

The bizarre tale ends: “Chad Thrasher was indicted and convicted of gross sexual imposition and is currently serving 18 months in the Ohio Department of Corrections.”

Evans seeks damages for assault, battery, negligence and emotional distress. He is represented by Dain Monroe of Cincinnati and Nadia Blaine of Wyoming, Ohio.
