from www.msnbc.com – The ugly fight isn’t over between Jesse James and second ex-wife Janine Lindemulder, parents to daughter Sunny, 6.
On Thursday, Lindemulder’s attorney filed a motion in an Orange County, Calif. court, asking for a modification in visitation, counseling for Lindemulder, James and their daughter, a child custody evaluation and $10,000 in attorney fees.
In the filing obtained by UsMagazine.com, former porn star Lindemulder, 41, says that her relationship with Sunny has become “estranged” since her daughter moved with James, 41, to Austin, Tex., adding that she hasn’t spoken to Sunny in 17 days. Prior to that, Sunny had made “extremely disturbing and inappropriate comments” about her, Lindemulder charges. James and members of his family, she claims, have turned Sunny against her.
“James, 41, “refuses” to help repair the mother-daughter bond, Lindemulder says, and “seems to enjoy and promote the disconnect between Janine and Sunny,” according to the papers.
Even before Sunny’s move from California to Texas, the little girl “was distant, confrontational, disrespectful and accusatory” toward her mom, the documents say. During one late July visit, the 6-year-old “made numerous offensive statements about me which she claimed she had been told by [James] and/or his family.”
Among Sunny’s supposed insults: comments about Lindemulder showing her “boobs,” that her mom is a “bad person,” should “get a life” and get a “real job.” (Lindemulder earned a certificate in clowning.)
Just before James’ Texas move, he and Lindemulder had an ugly incident at his Orange County home, where she had stopped to use the restroom before dropping Sunny off. James “became extremely irate, grabbed Sunny by the arm and virtually dragged her into the residence,” Lindemulder says. While Sunny cried, James “kept yelling ‘I don’t want her in our house.'” She adds that James “behavior towards me in front of Sunny, his neighbors, and his other children was humiliating, embarrassing and pathetic,” she wrote.
Even James’ other famous ex-wife, Sandra Bullock, is mentioned in the filing. In one spat, Sunny, with whom stepmother Bullock is still close, allegedly called her mother a liar, sniping: “Sandy said you lied to the police and that’s why you went to jail!” (Lindemulder served jail time last year on tax evasion charges.)
James’ behavior, Lindemulder says finally, has failed “to properly prepare Sunny for the move–and [has interfered] with my ability to contact sunny via telephone –and …with my visitation…I was not permitted to prepare Sunny for my absence.”
UPDATE: In a court response filed by his lawyer on Friday, James disputes his ex’s claims. “I have not interfered with [Lindemulder] calling Sunny and have not interfered with Sunny making calls to her mother,” he writes, adding that she often calls at “inappropriate times.”
Lindemulder, James says, has repeatedly called Sunny’s school “very distraught” demanding to speak with her daughter.
Another rebuttal: James claims that the last time the mother and daughter spoke, Lindemulder “told Sunny that she no longer wanted to be her mother and would not be seeing her or calling her again.”
His ex-wife’s conduct, James charges, suggests “she is not stable and acts impulsively and contradictory…[she] sounds …as if she is drinking or taking drugs again.”
