Jimmy Flynt Defies Lexington

Lexington, Kentucky – After less than two weeks in business, Jimmy Flynt has decided to ignore a city ordinance and has restocked his Hustler Hollywood store with sex toys, X-rated videos, pornographic magazines and books.

Flynt, who opened the store without pornography on July 16, has confronted the city on another front — asking a federal court late Friday to block Lexington’s ban on the display of adult materials near interstate interchanges.

The moves came as Flynt’s brother, Hustler magazine publisher Larry-Flynt, came to Lexington yesterday to sign his new book, Sex, Lies and Politics: The Naked Truth.

In an interview, Larry Flynt said a legal fight almost always ensues whenever a Hustler store is opened. He said the city “just can’t start making up ordinances” because he’s opening a store.

“They weren’t given the right to zone the First Amendment out,” he said. “Freedom of speech is not just what you love. It’s also the things you hate.”

The Hustler store’s newly stocked shelves drew a quick visit from city inspectors and protests from those who have fought the store for months.

After receiving a complaint, Dewey Crowe, Lexington’s deputy director of building inspections, said he asked an inspector to walk through the store at 2240 Elkhorn Road, near the intersection of Interstate 75 and Winchester Road.

Crowe said he would draft a notice that will tell Flynt which items are inappropriate. The notice will be delivered today. Crowe said Flynt will be given a deadline to remove the items or be cited for violating the ban on adult materials near interstates.

“We’ll give them an opportunity to correct it before taking legal action,” Crowe said.

When Jimmy Flynt opened his store July 16, city inspectors told him he was “significantly compliant” with the zoning code.

At the time, the inspectors’ only beef was a glass counter that displayed several ceramic figurines in various poses, some with exposed breasts. Flynt did a cover-up with tiny white and red “Hustler” ribbons, but now, those dolls are showing the goods.

Shelves that originally housed Hustler ashtrays, candles, shot glasses and other knick-knacks had been replaced yesterday. In their place were rows of pleasure devices with names like “Skinny Mini” and “Three-speed Sapphire Thong.”

On the opposite end of the store is a hanging rack with adult magazines.

Jimmy Flynt smiled as his staff re-stocked the shelves. “The UPS truck is late — my Hustler stuff is coming,” Flynt said, pointing to a display that will hold X-rated Hustler DVDs.

The People vs. Larry Flynt played all day on a plasma TV hanging from the ceiling. Usually, Jimmy Flynt said, the TV shows a pornographic Hustler production video, but because Larry Flynt was in town, he decided to play the movie that chronicles his brother’s climb to fame.

Pamula D. Honchell, an opponent of the Hustler store, begrudgingly entered the store for the first time yesterday.

Last fall, Honchell created A Better Lexington, a group of more than 150 people dedicated to fighting pornography in Lexington, and a Web site, www.abetterlexington.org.

Honchell conceded that-Flynt had a nice store, but “I still have a job to do.”

“I’m not angry; I’m disappointed,” Honchell said. “Mr. Flynt is trying to screw us all. He wants controversy.”

Jimmy Flynt first proposed the store last year, saying it would have a coffee shop with retail sales. But the city’s board of adjustment refused to give him a permit to open the adult book and video store.

His attorneys appealed in court. In March, the Urban County Council unanimously approved a zoning amendment to prohibit adult bookstores, video stores, cabarets, and adult dancing and entertainment establishments at interstate interchanges.

On Friday, attorneys for Jimmy Flynt asked a federal court to block that ordinance, saying the city has violated the store’s constitutional rights.

Bruce Edwards, a spokesman for Mayor Teresa Isaac, said the city was reviewing the motion. He declined further comment.

Flynt’s motion says the First and Fourteenth Amendments to the Constitution guarantee his right “to display and sell non-obscene sexually oriented materials to adult patrons.”

It says the city has denied Flynt his “protected expressive rights through the adoption and enforcement of overbroad laws that interfere with substantially more speech than permitted by the Constitution.”

Asked whether he would remove any merchandise after he receives notice from the city, Jimmy Flynt said, “Naw. Putting more up.”

“This is just another day at the office,” he said.

Jimmy Flynt also has stores in Cincinnati and Monroe, Ohio; Fort Lauderdale, Fla.; and San Diego and Hollywood, Calif.

The Lexington store has placed one restriction on its pornography.

Before entering the area that now has X-rated materials, there’s a small sign depicting a provocatively dressed woman clutching a stop sign. The sign says: “You must be at least 18-years-old to enter. Don’t worry if you’re not. … Hustler video will be here when you are.”

LEXINGTON, Ky. – A Hustler Hollywood store began selling sexually oriented adult material Monday, three days after its owners filed a federal lawsuit against the city claiming their constitutional rights were violated by an anti-porn law.

Jimmy Flynt, the operator of the store and the brother of Hustler magazine publisher Larry Flynt, has asked the court to strike down a law that forbids the sale of adult materials in certain areas of Lexington. The law was passed by the City Council shortly before the store opened July 16. Until Monday, it was not selling the adult material.

The law prohibits adult establishments at interstate highway exchanges in Fayette County. The Hustler Hollywood store sits near such an interchange.

Bruce Edwards, a spokesman for Lexington’s mayor, said Monday that the city had received a copy of the lawsuit “and it’s being reviewed.”

The Hustler lawsuit also seeks a temporary restraining order that would allow the store to sell adult materials. No hearing date had been set, according to the federal court.

Larry Flynt, visiting Lexington on Monday, said he and his brother “will go the distance” to be able to sell adult material at the store.

The Lexington store is one of seven Hustler Hollywood stores around the country. Others are in West Hollywood, Calif.; Monroe, Ohio; Cincinnati; San Diego; Fort Lauderdale, Fla.; and New Orleans.
