JustFor.fans’ parent company, JFF Publications LLC, has won a trademark infringement dispute at the World Intellectual Property Organization (WIPO) regarding the domain name "justforfans.app." The ruling, issued by a single-person panel, mandates the transfer of the infringing domain to JustFor.fans.

The arbitration ruling was officially issued in a letter last Wednesday by the Arbitration and Mediation Center at WIPO in Geneva, Switzerland. The case centered on a domain registered in Estonia by an individual named Ogandi Peraza.

Details of the Complaint

JFF Publications LLC, represented by its legal team attached to the French law firm Adsto, filed a complaint over the summer against Ogandi Peraza, an Estonian national. Peraza registered "justforfans.app" in 2021 through Cloudflare Inc., an ICANN-accredited domain registrar based in San Francisco.

In 2023, an entity tied to Peraza registered the trademark "JUSTFORFANS" with the Estonian Patent Office, located in Tallinn. JFF Publications owns a similar trademark, "JUSTFOR.FANS," in the United States, the United Kingdom, Canada, and France. The U.S. trademark for "JUSTFOR.FANS" dates back to February 2018.

The complaint was filed with the Arbitration and Mediation Center on June 16. Following the investigation, Peraza did not respond to requests from WIPO's Arbitration and Mediation Center. This lack of response was noted as working in JFF's favor, leading panelist Rebecca Slater to transfer ownership of "justforfans.app" to JustFor.fans.

It was also revealed that Peraza utilized the infringing domain name to promote a digital subscription platform under the same name as JFF Publications' marquee website.

Panel's Determination

Panelist Rebecca Slater stated in the determination letter, "Having reviewed the available record, the panel finds the complainant has established a prima facie case that the Respondent lacks rights or legitimate interests in the disputed domain name." Slater further elaborated that this finding was "reinforced by the respondent's use of the disputed domain name to provide a subscription service and platform which is very similar to the complainant’s offering."

Slater characterized this action as "opportunistic bad faith" under WIPO policy. The panel found it "unlikely that the disputed domain name was registered without knowledge of the complainant and its unregistered JUSTFORFANS mark, given the reputation of the complainant and the composition of the disputed domain name." The ruling authorized the transfer of the domain's ownership.
