“Kayden Kross Was Absolutely Out of Control”

I had a conversation with Scott Henley, the consultant that was involved in the real estate deal in which a homeowner named TJ lost his house of 15 years because of Kayden Kross’ alleged malfeasance.

In the first part of our conversation, Henley, who’s also had felony charges brought against him, attempted to get to the bottom of some fancy dealings among Kross, her porno chums, Tim Ngo, Ed Axelrod, and the Washington Mutual bank in Pasadena.

That’s where my chat with Henley left off. There are people taking these threats very seriously while Mike South, an admitted shill for Kross, guffaws like an inebriated jackass on his shill website. South might laugh all he wants to about these stories, but if Kross has been playing him for a patsy and a sucker, they’ll be flogging each other with a bag of dead chimpanzee eyeballs by the time this is all over.

Henley certainly took the threats to the extent where he filed a police report.

“But they pretty much stopped digging into it,” he tells me. According to Henley, there’s at least another deal Kross was in that hasn’t brought charges. A guy named Sergei Borgon was involved in that one with her.

All told, Henley thinks Washington Mutual may have been defrauded for as much as $500,000 in these deals. Not that Kross would have gotten all that money. At the end of the day, the loan officer at Washington Mutual who green lighted these tickets would appear to be worth investigating.

“All this information was brought to the investigating detective [a Det. Freeman]. But none of it was included in his report,” says Henley. “In my opinion he’s withheld this information from the prosecutor. And of course that’s going to be the basis of my civil lawsuit once I take care of this criminal BS.”

“Bottom line, Kayden wants to portray herself as innocent,” Henley continues.

“She’s not. She knew exactly what she was doing. She made no mortgage payments whatsoever. She hassled me for over a month and a half to complete the deal she said she was going to do. And there’s evidence at the end that didn’t make it into the detective’s file.”

And why it didn’t, will be part of Henley’s civil suit. But the fact jumps out like a crazed cricket that perhaps Freeman and Kross might have gotten a little chummy. Of course South scoffs at this notion as well because it would be impossible for a professional sodomite to behave like that.

To bolster his claims, Henley can produce copies of text messages in which Kross is supposed to have said to TJ: “Hey, I’m not going to lose money for you guys. I’m going to go ahead and give these properties to people who can do something with it.”

I asked Henley if he ever met this mysterious Tim Ngo character who all of a sudden became the new owner of TJ’s property. That has since changed. Henley says no, but that there’s something very weird there.

“When you sign a deed of trust it’s notarized,” he continues. “You have to sign a notary ledger and put your finger print. You have to produce valid California identification. But there’s been no investigation into Axelrod [who was conveniently the notary].

“No investigation into Tim Ngo which would have been pretty simple to do. Obviously the detective is a lazy sonofabitch and he’s like, okay, I could put these various civil code violations on these guys; I’m not going to do the hard work to go and find these dudes.”

“The detective knew very early on when he did a title search that these deeds existed,” speculates Henley.

“Unless he’s an absolute idiot, but I wouldn’t put that past him because he’s not the sharpest tool in the shed. The detective was aware that the properties were encumbered to over 200% of the value. He knew that when he did a title search very early on. Why that didn’t dawn on him as being strange, I don’t know. Why he didn’t listen to me when TJ and I went to him and explained the situation, I don’t know.”

“At that point the detective said Scott, if you’re involved in this, if I’m going to talk to you I’m going to Mirandize you. At that point I was fuck you. I’m not going to talk to you worth shit. You’re going to Mirandize me? I’m here reporting this to you, asshole.”

Henley agrees with my assessment that these were pros who have done this type of thing and gotten away with it before.

“Now knowing that they’re in the porno business it wouldn’t surprise me for a second,” he says. “They have this inside guy in Washington Mutual. And then they probably fund their porno stuff using this cash. Talk about liquid. We’re talking about a credit line, the very next day that $246,000 was liquidated. That’s quarter of a million cash. They didn’t make any payments.”

“They use a different patsy to take out loans every different time. Once it was Tim Ngo. In another deal it was Olga Berger. Once it was Sergei Borgon of the ones that I know. If they got this little syndicate and an inside in Washington Mutual and Optima to make any property look unencumbered, all they need is a person with a good FICA score.”

“And at that time you could get a loan with no goddamn problem as long as you had a good credit score. And the banks loved to write that shit. Now they won’t touch it. But they did it all the time. They wrote almost a trillion dollars in 2006 in equity lines. It was big business for the banks.”

According to Henley, it’s fairly obvious now that the DA’s office wasn’t privy to all the information the investigating detective had.

“But he decided in his mind who was at fault and went with it and constructed his case accordingly.”

Even more strange is the fact that, considering Kross’ stature in the porn community and being from Sacramento, none of this has been reported by the Sacramento Bee or other papers. Because he’s a party to the story, Henley calls it a “Pandora’s Box”.

“Once you open it, you can’t shut the sonfabitch,” he says.

Henley describes how he was arrested in front of his kids and spent two days in LA County jail.

“I had to pay $10,000 bond to get the hell out,” he mutters. “Otherwise I would have sat there until they extradited me to Sacramento County where I would have sat for another two weeks before I would have seen a magistrate. So I’m fucking pissed.”

“What they got me on was a garbage charge- taking money, an interest in a house in foreclosure, from a third party. Because it as over $400, they tagged on 487 Grand Theft. There may have been procedural errors but in 487 Grand Theft you have to have the intent of stealing from these people. That’s absolutely not the case.”

“They lived in my house rent free for a year because of this whole problem. They had nowhere to go. No one else was stepping in to help them. They called Kayden Kross. She told them to fuck off. Tim [Hough- Kross’ boyfriend who brought her into the deal] is hiding because he had a prior criminal record and doesn’t talk to cops.

“It comes down to me. I’m the one with TJ going to the cops. I’m the one stupid in that sense. But my conscience said this is bullshit and we’re going to make sure this is straightened out.”

Henley claims at one point he told Kross to return the money that they could make the mortgage payments with it, and he’d take title for the properties and make sure everything was paid.

“I told her in a year I’ll buy them from you. At that point I showed them a pro forma of my company. At the time I had substantial resources to be able to do that. She flatly refused and was pissed off. It became pretty clear to me that there was an ulterior motive. My suspicion is she already made the connection with these guys- Axelrod and Ngo- down in LA who were going to get her into porn.”

Henley, with his family credentials, is basically saying, you’re going to put me up against a porno star in court? You do that.

“Bring your evidence to court and I’ll smash you,” Henlsey says of Kross.

Henley says at first Kross seemed nice.

“She was polite- when things went sour, she went to super bitch. She was absolutely out of control, unbelievably difficult to deal with. Unbelievable.”
