Minneapolis – from www.kstp.com – A former Cretin-Derham Hall High School teacher has agreed to be found guilty of a misdemeanor for having sex with one of the school’s students, according to the Hennepin County Attorney’s office.
It’s not a guilty plea, though. Twenty-eight-year-old Gail Gagne will learn next month if the judge decides she’s guilty or innocent.
Gagne worked at the private school as a teacher, basketball coach and weight room supervisor. She is accused of developing a sexual relationship with a student who used the weight room.
According to court documents, the student said the relationship lasted from the summer to the fall of 2008. The student was 16. Gagne was 25.
The student said Gagne and he met at her Bloomington home and at a hotel near Mall of America.
Cretin Derham Hall put Gagne on leave as soon as police started investigating the allegations in May 2009.
In December 2009, Gagne was charged in Hennepin County District Court with two felony counts of criminal sexual conduct; the charges were filed in Hennepin County.
Gagne’s defense attorney, Earl Gray, and Assistant Hennepin County Attorney Judith Hawley agreed to a stipulated facts trial earlier this month, meaning both sides settle on a set of facts and submit them to a judge. The process avoids a jury trial and witnesses don’t have to testify in open court.
According to the stipulation, Gagne agrees that if the judge finds her guilty, she would be found guilty of fifth-degree sexual conduct, a gross misdemeanor instead of a felony.
A sentencing hearing has been scheduled for March 28 if she’s convicted.
Gagne is from a well-known Minnesota family. Her grandfather is pro-wrestling legend Verne Gagne.
