> On www.xxxporntalk.com , Christian XXX raises the issue: I have a question.
many adult film stars have children (some under 2 years old). Should they be afraid of Child Protective Services coming after them for doing scenes? I always wondered about that. Is there a legal precedent?
> Michael Fattorosi www.adultbizlaw.com replies: I went through this with Tiffani [DiGivanni] in NM. At first the Judge was all not too happy with a pornstar fighting for custody, however, after several appearances, the Judge realized that porn doesnt necessarily mean bad mother. She later turned against the ex and basically supported Tiffani despite her career choice.
Less important than the career is the stability of the mother. Porn alone should not make a difference. Drug use, alcoholism, lack of a stable home environment all are more important than the career path chosen in my opinion.
Each case will be different though.
> Christian replies back: i already the answer to the custody question Michael. My question is more about the question of an infant (like a child under the age of 2). can CPS step in or is that out of their jurisdiction?
> Fattorosi answers: CPS can step into a situation involving a child for basically any reason. They are there to protect children. The final arbitrator will be a judge though. The hearing as to custody will eventually find its way before a judge and he/she will make the call.
CPS can be overly zealous with their decisions at times.
