from www.bizjournals.com – A federal court in Cincinnati has ruled that Larry Flynt is the rightful owner of the pornographic magazine Hustler, cutting off co-ownership claims by his brother, the Cincinnati Business Courier reports.

Jimmy Flynt had claimed he was a partner in the business and asked a judge to give him half the company, but U.S. District Court Judge William Bertelsman said Larry Flynt has been the clear leader of the company for most of its 40 years and that he became its sole shareholder in the 1970s, the paper reported.

Flynt’s business now includes stores, clubs, videos and publishing enterprises. He said this week he wants to put a Hustler Hollywood store in Clintonville.

The former Bexley resident and publisher of Hustler magazine will open a Hustler Hollywood retail store just south of Clintonville and north of the Ohio State campus, on the site of a former Tan Pro, at 2761 N. High St.

Neither Flynt nor representatives of his publishing company returned calls seeking comment, but Flynt was seen in the neighborhood yesterday. His stretch limousine stopped at nearby Mozart’s Bakery and Piano Cafe. Flynt visited the bakery and restaurant in his gold wheelchair, Mozart’s owner Anand Saha said.

Members of the Clintonville Area Commission confirmed that the site is being converted to a Hustler Hollywood store.

Larry Flynt Publishing Inc. owns about 10 Hustler Hollywood stores, including one in Cincinnati and one in Monroe, Ohio. The store in Monroe, north of Cincinnati, was Hustler Hollywood’s most-successful retail outlet in the country and prompted Flynt to open the Cincinnati store in March, according to The Cincinnati Enquirer.

The shops – which have been described as “an upscale combination of sex shop and coffee bar” – sell merchandise such as lingerie, swimwear, sex toys, glassware and other adult novelties.

Flynt opened the first Hustler Hollywood store in late 1998 in West Hollywood, Calif. Other stores are in Fort Lauderdale, Fla.; Nashville, Tenn.; New Orleans; San Diego; and St. Louis.

The notion of an adult-oriented business in the neighborhood wasn’t news to some members of the Clintonville Area Commission, but the Hustler Hollywood name was a surprise when they first heard.

The site, next to a White Castle that is slated to be razed, left one commission member, Jim Blazer, bemused.

“Good old Clintonville, Ohio, next to the old White Castle,” Blazer said. “It’s kind of a strange place for Mr. Flynt to come and set up shop. It’s not necessarily what I would pick, but I guess it takes all kinds.”

Like it or not, there appears to be little the commission or neighbors can do, commissioners said.

“It doesn’t look like they need any zoning variance,” commissioner Mike McLaughlin said. “So I think Clintonville needs to look at its zoning. The development plan is promoting Clintonville as a pedestrian-friendly neighborhood where you walk with your children and get ice cream. I don’t think this is conducive to that plan.”

Blazer said, “I’m not sure how it’s going to improve the neighborhood. What are they going to do to enhance the lifestyle in Clintonville? I think it’s kind of unfortunate.”

Flynt began his business in 1965 when he opened his first bar in Dayton. He opened Dayton’s first go-go bar, the Hustler Club, in 1968. The success of that bar prompted him to open a string of Hustler Clubs across the state, in Akron, Cincinnati, Columbus, Cleveland and Toledo. In 1974, he published the first issue of Hustler.
