Philadelphia- A Montgomery County judge issued an order this week directing lawyers to move ahead with the case of a woman charged with lying to police about the death of a porn star.
The order states prosecutors have 30 days to hand over evidence to the attorney representing Jennifer Mitkus, 30, of Oaks.
Mitkus, who has been in Montgomery County Prison since March, is charged with unsworn falsification to authorities and hindering apprehension for allegedly lying to police about her last contact with Canadian porn model Natel King.
Judge William T. Nicholas also ordered Mitkus’ attorney, Carolyn Carluccio, to be specific in her motions asking to suppress evidence.
Carluccio said Wednesday she can’t prepare the case for her client until she knows what evidence prosecutors have against her.
”If they’ve got it, bring it on,” she said. ”She’s been sitting in jail since March and I’m still not convinced they have a case against her.”
Earlier this month, Carluccio asked a judge to disallow any evidence against Mitkus being used at trial.
Prosecutors also filed a motion asking a judge to bar Carluccio’s motion because it was too ”vague.”
Carluccio filed another motion stating it was impossible for her to prepare for trial when the prosecution has not turned over evidence.
” is not on the street, but is sitting in jail and is incredibly frustrated, and understandably so,” Carluccio said. ”This is the first thing she’s ever been arrested for and you shouldn’t be sitting in jail for allegedly lying to police.”
Mitkus, who was living in a motel in Oaks, has been in prison since her arrest and has been unable to post $10,000 cash bail.
Prosecutors said King, 23, was stabbed to death during a bondage photo session in Conshohocken. Anthony Frederick, 41, of Eagleville, was the photographer in that session and has been charged with King’s murder. He remains in the county prison with no bail.
Mitkus told police the day of King’s photo shoot on Feb. 29 was her first day to work as an assistant for Frederick.
Frederick’s formal arraignment is scheduled for July 12.
