Georgia- On Thursday, April 10, the city of Johns Creek Chief Code Enforcement Office Reginald Miller hand delivered to the Love Shack the City’s letter of intent to deny the Love Shack in Johns Creek its 2008 business license.
We can only surmise that the reason the City did not release a press release on the matter is the reason for the denial clearly shows that no matter what the Love Shack does, the City of Johns Creek will continue to deny its business application is simply out of spite.
A hearing on this matter will be held on May 7, 2008 at 1 pm in the City Council Chambers in Johns Creek. Love Shack owner John Cornetta [pictured] and his attorney Cary S. Wiggins will be there to discuss the matter.
In reading the 23-page denial letter from the City, posted at www.Cornettta.com and www.LoveShackOnline.com , it appears that all of the facts, findings and research were conducted PRIOR to the Feb. 28 decision by Fulton County Superior Court Judge Ural Glanville that the Love Shack was an adult business operating in a non-adult zoned area.
However, in Judge Glanville’s letter to Cornetta and the Love Shack, Judge Glanville instructed the Love Shack that it must comply with the City of Johns Creek’s sexually oriented business ordinance.
Since that Feb. 28 decision by Judge Glanville, the Love Shack in Johns Creek re-evaluated its inventory, shuffled around some items and re-applied for a 2008 business license in the city of Johns Creek.
Since Feb. 28, the Love Shack was inspected no less than 35 times by Miller and there are no notes from those inspections incorporated into the letter by the City of Johns Creek in its intent to deny the Love Shack of its 2008 business license.
“We look forward to the hearing on May 7 before the city of Johns Creek,” said Love Shack owner Cornetta. “We stand proud knowing that we are right and we look forward to receiving our 2008 Johns Creek business license shortly. I said a long time ago that this was nothing more than a witch hunt by Mayor Bodker and the Johns Creek government and that we’d prevail when this was all over. That time will shortly be upon us.”
