Rome, Georgia- Georgia’s attorney general plans to aid Floyd County in its effort to enforce an ordinance that would keep the county’s only adult bookstore from operating in its current location.

Floyd County is seeking dismissal of a lawsuit Entice Adult Superstore filed in August. Meanwhile, Georgia Attorney General Thurbert E. Baker has successfully requested “to be heard” on the issue and will file a brief within 45 days.

Baker will be an interested party. This will allow Baker to enter his opinion in the case, in which he will support Floyd, but he will not be liable to the outcome.

Entice is challenging the Floyd County Commission’s ordinance restricting sexually oriented businesses. The store on Ga. 53 in Shannon claimed the ordinance specifically targets it and is intended to put it out of business.

Floyd County filed a response in November stating it did not know the nature of Entice’s business in the early stages of development and offered evidence of the negative impact of adult-oriented businesses that focused mostly on crime. Both sides are seeking summary judgment.

The ordinance, enacted in May, less than a month after Entice opened, requires sexually-oriented businesses and employees to get annual licenses. It also bars such businesses from operating within 1,000 feet of land zoned for residential suburban – a standard that Entice does not meet.
