from www.coloradoan.com – A former Brighton teacher was arrested this week on her second alleged probation violation since a 2007 conviction for sexually assaulting a student during a class trip to Estes Park, according to Colorado court records.

Carrie Day McCandless, 34, remains in custody at Larimer County Jail today.

Her probation was revoked after McCandless tested positive for morphine in her system in April on a court-ordered drug test, according to a complaint filed to revoke her probation.

She also had been arrested on drunken driving charges outside Colorado in September 2010 and was sentenced to 12 months probation, which violates her Larimer County probation conditions, according to the court document.

McCandless claimed the drug test results were caused by a prescription from an online pharmacy, but a probation officer confirmed with the pharmacy that the drug wouldn’t cause a positive test for morphine, according to the court document.

McCandless was most recently living in Cumming, Ga., according to Larimer County Sheriff’s Office records, and the national sex offender database indicates she last registered in Hiram, Ga. last December.

After her conviction for a sexual relationship with a 17-year-old student from Brighton Charter High School, McCandless was required to register as a sex offender, which included five years of intensive supervision and permission from parole officers before she sought sexual contact with others. Her sentence included 45 days in jail.

In March 2008 she served 30 days in jail after a Weld County probation officer found McCandless in bed at the apartment of another parolee, who wasn’t her husband or the juvenile victim, according to previous reports from the probation department of Larimer County’s 8th Judicial District.

McCandless was arrested Tuesday at the jail, and she’s scheduled for a possible disposition hearing May 19.
