England – www.express.co.uk – A TEACHING assistant who had sex with a 15-year-old was spared jail yesterday after a judge said the boy made the first move and had not been “corrupted” .

Leah Davies, 30, slept with the boy after they watched a DVD and drank vodka.

She had been invited to his home after she struck up a friendship with his mother. But at the end of the evening the boy’s mother went to bed, leaving them alone. Mother-of-one Davies chatted to him about his favourite music and films before having sex with him on the lounge sofa. He later confided to his aunt about the fling and police were called in.

At Manchester Crown Court, Davies, who taught at several primary schools, was convicted of four counts of sexual activity with a child. She is now a cleaner.

She denied wrongdoing, saying the boy was “attention seeking”. She was given a 12-month jail sentence suspended for two years plus a 24-month supervision order. Judge Martin Rudland said she was an “ordinary, decent, hard‑working woman who made a tragic, foolish mistake”.

He said the boy, now 16, was sexually experienced and touched Davies, of Fallowfield, first. He added: “He was not seduced or corrupted by the experience.”

Davies, a close family friend for three years, first kissed the boy in autumn 2009 and another time performed a sex act on him while he wore his school PE shorts.
