LOS ANGELES — from www.xbiz.com The sentencing hearing for convicted producer Ira Isaacs scheduled for this morning in U.S. District Court has been postponed.
Isaacs’ defense attorney Roger Jon Diamond told XBIZ a new date has not yet been scheduled. He added the cancellation was not unusual.
“I received a phone message at 8:30 a.m. on Friday from a substitute clerk for Judge George King,” Diamond said. “The message said the case was taken off the calendar and a new date would be communicated to me by court order.”
Diamond said there are numerous reasons a sentencing date may be postponed, including practical reasons such as the judge calling in sick or being on vacation. Diamond has already had three scheduled court dates for three different cases vacated this week alone, he said.
In April, Isaacs was found guilty on five federal obscenity charges for the distribution of four films — “Mako’s First Time Scat,” “Hollywood Scat Amateurs #7,” “Hollywood Scat Amateurs #1” and “Japanese Doggie 3 Way.”
On Aug. 2, federal prosecutors filed a brief asking Judge King to consider Isaacs’ post-conviction conduct, maintaining that he continued to sell obscene material even after he was convicted on five federal obscenity counts. Diamond said it was possible the judge needs more time to consider that brief, but that he was given no specific reason for the cancellation, which is also not unusual.
“I’ve had situations where they don’t tell you in advance,” Diamond said. “It’s always nice when they let you know in advance to not show up to court.”
Judge King on Aug. 1 made a preliminary order ruling Isaacs must forfeit all of his websites — ScatMovies.com, VeronicaJett.com and ToiletJasmine.com, among 40 others — and copyrights, as well as the movies deemed obscene.
The order went even further, noting that Isaacs also must forfeit all computers, servers, props and video equipment as well.
