Los Angeles- A judge has issued a temporary restraining order telling the nephews of porn publisher Larry Flynt that they must they must include a disclaimer if they want to produce adult films bearing the family name.
U.S. District Judge A. Howard Matz on Wednesday told Dustin [pictured] and Jimmy Flynt II they must place large notices on both their DVDs and Web site that the products are in no way connected to Larry Flynt, who publishes Hustler Magazine and a host of related media.
The nephews worked for Larry Flynt for more than a decade before he fired them last year, and a bitter battle over the family name ensued.
The nephews plan to release seven DVDs under the name Flynt Media Corp., and Larry Flynt sued for copyright infringement.
"They don't want to be affiliated with their uncle, but they do want to use their last name," said the nephews' attorney Andrea M. Kimball.
The judge set a trial date of July 28. Both sides indicated that they would try to settle before then, though the judge said a meeting between the Flynts was not well-advised.
"When you have an uncle and two nephews at war with each other, sometimes it's better to keep them apart," Matz said.
