ZUMBRO FALLS, Minnesota [www.news.postbulletin.com]- — A judge is ordering Zumbro Falls’ controversial strip club — the Pussycat Cabaret — to close down.
Wabasha District Court Judge Terrence M. Walters issued an injunction Friday stating that the strip club in the city’s business district must close.
The city council passed an ordinance on Jan. 14 that banned nude dancing and put a temporarily moratorium on all adult businesses in the city limits. The strip club opened the day before on Jan. 13.
While the Pussycat Cabaret opened before those rules were approved, “it would appear the defendants had not yet obtained all necessary permits from the city of Zumbro Falls,” the judge wrote.
That means the club was not completely open and is subject to the new city rules.
The club was opened by Jeff and Shakiba Dewitz of Rochester who had owned the Showgirl Saloon in Austin, which featured nude dancing. The city of Austin bought out their property in Austin as it helped prepare for the justice center project.
This is the second legal defeat the club has suffered recently.
On Thursday, a federal judge dismissed a complaint filed by Pussycat Cabaret against the city about the constitutionally of licensing rules and state law that limits where adult entertainment businesses can operate.
