TAMPA, Fla. — A Florida judge has ordered authorities to return about $63,000 that was seized during the execution of a search warrant at Dirty D's home in March when police had reason to believe that Dirty D was involved in shooting underaged performers.

Despite the court order, the case against Dirty D and two others is "still going forward" and that a court date has been set for Sept. 22, according to a story reported by www.xbiz.com

Dirty D was arrested and charged with two counts of the promotion of a sexual performance of a child and two counts of the use of a child in a sexual performance after a woman claimed that she was underage at the time of a Tampa Bay porn shoot in August 2007.

Also charged were two of Dirty D's employees — Shawn Chastain and Ryan Jay Holtz — with two counts each of promoting a sexual performance by a child.

Dirty D has always maintained the allegations are false and that the woman, who goes by the porn pseudonym Kelsey Cummings, among others, apparently used a fake ID for productions that involved both a gloryhole shoot and a solo scene at a home.

In addition to seizing cash at his Tampa Bay home, authorities confiscated videos and 10 terabytes of data.
